I think the thing that’s being missed is that it was a washable marker. A wet washcloth would remove it. Immediately. There are so many serious things in life that I just don’t see a washable rose as one of them.

Exactly. I mean, you'd tell your wife to laugh it off if the plumber left his calling card in her undie drawer, cuz she could just throw it out.

Or if I hacked into your computer and left a note to you that you could obviously just delete.

Nobody would ever feel uncomfortable with that! </sarc>

On what basis do you assume no harm?

Do you think she's suffered grievous psychological damage from a picture of a flower that's probably already disappeared? It was a silly thing for the surgeon to do but not worth monetary damages or a court's time.

Doctors should not be doing extracuricular things to patients, especially when they are under. I don’t know if she should get a settlement, but this doctor should lose his license. He probably isn’t “all there” if he did this.

well, truth be told, i was kinda kidding. this was pretty stupid of the doc. in today’s society the whole god complex is a little tired. just do what you are paid to do and move on. have some integrity and professionalism.

This is a battery case. Here is the Model Jury Charge that what the Judge will tell the jury at the end of the trial:

3.10 ASSAULT AND BATTERY (Approved before 1984)
A. Definition
An assault is an attempt or offer to touch or strike the person of another with unlawful force or violence. A battery necessarily includes a preceding assault and in addition extends to the actual touching or striking of the person, with the intent to do so, with unlawful force or violence.
The terms violence and force mean the same thing when used in relation to assault and battery and include any application of force to the person of the plaintiff even though it entails no pain or bodily harm and leaves no mark. No particular degree of force or violence is necessary for an assault and battery and therefore the least touching or striking of the body of the plaintiff without legal justification against his/her will constitutes an assault and battery.
Cases:
State v. Maier, 13 N.J. 235, 242 (1953); State v. Adamo, 9 N.J. Super. 7, 9 (App. Div. 1950); Clayton v. New Dreamland Roller Skating Rink, Inc., 14 N.J. Super. 390, 398 (App. Div. 1951); Falconiero v. Maryland Gas Co., 59 N.J. Super. 105, 109 (App. Div. 1960).

It saved me. I was barely able to walk, I could not drive, and I was in pain 24/7. They removed L5,S1 and I am fine now.

Recovery was long, but I am so glad I did it. The pressure on the sciatic nerve was unbearable.

You are blowing it out of proportion. And as I said in a post earlier, it's possible the incision was IN THE FRONT. It causes less scarring and nerve damage. And your examples are not anywhere near enough to be analogous. Surgeons use markers to mark where the incision should be. He probably already had the marker.

He's also known as one of 3 best surgeons in south Jersey. This seems to be a gifted surgeon. I googled him. Oh and the article said he does this and no one complained before.

Some spinal procedures have to be done by going through the front.

Mine went through the front first then through the back.

I had a doctor do something similar to me while I was under anesthesia.

I was having a “female type surgery” but the smiley face “tatoo” mark was left on my hand. That is the difference here. I think if I were this lady and had the tatoo been left on my hand or arm, I would have been ok with it. There is just something weird about leaving it below the panty line.

Still, I wouldn’t sue over it. I would express my disappointment with his conduct to him as well as the hospital administrator.

No other patients have ever complained about it.

It was washable marker.

He's listed as one of 3 top docs in south Jersey.

I’m glad that it worked for you. It can be awful. I think it depends a lot on the doctor. Hubby has a friend that it worked for but I’m still a coward. LOL

I believe the last two lines of the article, certainly within the last three made it clear it was surgery on the back, tattoo on the front. There was another place in the article where it was a little more ambiguous.
