Illegal Immigrant from Honduras Facing Execution Texas does it again!)

An illegal immigrant from Honduras who claimed his treaty rights were violated when he was arrested for a robbery-murder near Dallas lost his appeal ... at the U.S. Supreme Court, clearing the way for his execution.

In the second case of its kind this week in Texas, lawyers for condemned killer Heliberto Chi went to the nation's highest court claiming Chi should have been told he could get legal assistance from the Honduran consulate when he was arrested in California and extradited to Texas to face charges for killing his former boss at a men's clothing store during a robbery 7 1/2 years ago.

Chi... was scheduled for lethal injection for the fatal shooting of Armand Paliotta.

The Supreme Court, ruling about 2 1/2 hours before his scheduled execution time, rejected his appeal without dissent.

The arguments in his case, focusing on rights of foreigners under international treaty, were similar to those used unsuccessfully Tuesday by lawyers for condemned Texas prisoner Jose Medellin. In that case, the Supreme Court, with four of the nine justices dissenting, rejected his appeal and the Mexican-born Medellin was executed for participating in the gruesome gang rape and murders of two teenage Houston girls 15 years ago.

President Bush asked states to review those cases and legislation to implement the process was introduced recently in Congress, but the Supreme Court ruled earlier this year neither the president nor the international court could force Texas to wait.

I cannot see why this nation should be under any legal obligation to inform foreigners, whether here legally or illegally, about their rights as citizens of their countries.

One reason is because we agree to do so in exchange for a promise by other countries to do the same in the case of a U.S. citizen arrested in those countries. Of course, Americans aboard are rarely illegally in another country and as a rule behave lawfully when there.

Don’t you think the illegals would get the message now and flee Texas to go to Massachusetts and other lily-white states in the New England region where they have compassion for the “unfortunate poor”?

We obligate ourselves by treaty to do this simply in order to assure that the other country will reciprocate when they have cause to arrest a US national.

If you were in Honduras and were arrested by their police force, I'm reasonably sure you'd like to know that the US consulate would be informed.

I don't know whether it applies to this last pair of murderers but, in the past, Texas has proceeded to execute several illegal aliens who never volunteered their true status. As a consequence, the state didn't even know they were foreign nationals until the case reached the appeal process.
