Judge seals UND "Fighting Sioux" lawsuit; AG decries judge's order

BISMARCK, N.D. (Legal Newsline)-North Dakota Attorney General Wayne Stenehjem said Wednesday he opposes a judge's decision to seal all future documents in the University of North Dakota "Fighting Sioux" lawsuit against the NCAA.

Northeast Central District Judge Lawrence Jahnke said he wants the parties to move toward a settlement.

Stenehjem, whose office is representing the university, said he believes sealing the records violates the spirit of open records.

Wonder if the NCAA has plans to ask Notre Dame to change their nickname anytime soon. It must be horribly offensive to the Irish.

Violation of the spirit of the Open Records laws is Myles Brand’s trademark.

He convened serial meetings with Board members when he was the President of Indiana University, and the University was later sued. He admitted under oath that serial meetings were used to transact business out of the public eye by avoiding a quorum.

He talks the ‘ethical’ game, but he and any organization he heads up is as slimey as they come as far as skirting rules and operating in secret.

I've been following this for awhile....

Ralph Engelstadt (sp?) is a humongous contributor to NoDak. As in, the hockey team plays in "Engelstadt Arena" and so forth.

The administration was gung ho to get the name changed. They did a 180 when Mr Engelstadt informed them he'd pull the plug on their donations if they did. Good for him.

If I remember correctly, the local Sioux Nation wholeheartedly supports the name. As well they should.

I am absolutely dumbfounded.

The purpose of a sports mascot is to depict toughness, fighting spirit, etc. How can the fact that lots and lots of sports teams and schools use Indian faces, emblems, and names be anything other than complimentary? Why is this harmful?

Admittedly, some use of Indian faces and emblems is less than positive, but in the sports teams instance I think somebody is seriously overreaching.

What good does the NCAA do these days? Isn't it more like the UN than not?

The AISTM (American Indian Sports Team Mascot) site also complains about Warner Brothers cartoons between 1937 and 1960. Sheesh!

Myle's Brand set the stage for his predecessor at IU's disastrous tenure. A campus that had never seen real "violence" at a fraternity or sorority, ended up having three of them burn to the ground.

(The successor was quickly sacked and replaced with the present incumbent).

I've always found it curious that the "anti-Indian team nickname" NCAA is headquartered in Indianapolis, Indiana.

All institutions using injun names should immediately drop their old mascots and start using the names of European peoples and tribes (who don’t sue), like Trojans, Spartans, Saxons, White Skins, etc.

The exception would be the Seminoles who told the NAACP to pack sand.

And I don’t have high hopes for the predecessor either.

He’s doing more of the same: reward failure and incompetence by promoting the culprits. Prime example, the recent shutting down of the primate research facilities which is a small scandal now.

Or, the ultimate, use one of my own "tribal ancestor" names ~ Skolt, for the basketball team somewhere.

Maybe use Inari for the football team.

I don't care. Make me feel good, and them too. When you look them up I believe they have the highest percentage of dwarves of any "ethnic group" among the so-called "white people" in Europe.

If the Indians have no need for a psychological boost screw 'em!
