Apparently, Ann and Nancy Wilson are suing the McCain/Palin campaign over use of "Barracuda"

Ann and Nancy Wilson are pissed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.
Specifically, the Heart women are upset that the GOP has used their classic "Barracuda" as a theme song for Sarah Palin. TMZ obtained a statement from Heart's rep, who says "The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission."
The statement goes on: "We have asked the Republican campaign publicly not to use our music. We hope our wishes will be honored."
We're told Ann was watching TV today and heard the song at the convention when Palin was touted.

They did the same thing to Dole in ‘96 when he used a variation of “Soul Man” ... if the Heart group weren’t three full decades years in the past, we could recommend a boycott of their product. I’m not sure the copyright is still in effect.

Can they do that? Well, they can ASK. I think the publisher would be OK with it if they were paid public performance royalties.
When Sarah was first announced they played a cue from Jerry Goldsmith's score for RUDY. While Goldsmith was a Kerry contributor, he's also, alas, deceased, so maybe they should just switch back to that.

There are copyright issues in films, and written material etc. However having purchased the music and playing it at a ‘party’ is not something they can sue over. Since it is heard on the loudspeakers and thus published over the TV, I am unsure what the copyright issues are. However in response I think we should say fine. Everyone quit paying to download their song. We will play what we have. These have beens should feel grateful anyone even pay for their work any more. Hey Ann and Nancy as a previous fan from the NW I say . . . STUFF IT, Bs! No more download for you.

They just need to note when it was played and report it to ascap, if they ask for it. Kind of surprised since G. Wilson appeared at the RNC convention. IF Heart turns out to be RAT’s I will be disappointed.

You pay for a license to use the recordings. I’m sure the proper fees were paid for use of all musical recordings.
The whining by the artist is symbolism, their permission is not required to play the music.
