I think the constitutional question will come down to can he serve, not can he run. I know it's a nuance, but one that a lawyer can exploit.

So, a judge may hold off on discovery until after the election, because if Obama loses then it's a moot point and doesn't need to be addressed.

If Obama wins, then it might create a constitutional crisis, which would put it in larger hands than this judge.
