Barr Files Suit To Remove Obama And McCain From Texas Ballot

Libertarian presidential nominee Bob Barr’s campaign filed suit Tuesday seeking to remove Republican John McCain and Democrat Barack Obama from the ballot in Texas, alleging that the two major candidates missed the deadline for officially filing to be on the ballot.

The lawsuit by the former Republican congressman from Georgia claims that neither McCain nor Obama met the requirement of Texas law that all candidates provide “written certification” of their nomination “before 5 p.m. on the 70th day before election day” because neither had been formally nominated by their respective parties in time.

That would have been Aug. 25. Obama did not accept his party’s nomination until Aug. 28, McCain his on Sept. 4.

The lawsuit states: “The hubris of the major parties has risen to such a level that they do not believe that the election laws of the State of Texas apply to them.”

Pat Dixon, chairman of the Texas Libertarian Party, issued a statement saying, “Libertarian principles require personal responsibility for your acts and failures. Obama and McCain failed to meet the deadlines. They must follow the law like everyone else.”

The sad part is, the Barr/Baldwin types actually think a majority of Americans want them but they are being oppressed by some media/neocon conspiracy and people are just ‘sheep’ who don’t know the truth.

IE, it is everyone else’s fault, they are just being oppressed.. uh huh.. narcissistic and delusional.

i dont agree with what he’s doing, but barr does have a point with this, if its true. There’s deadline laws, one shouldn’t think it doesn’t apply to you

I’m starting to think some candidates run on 3rd party tickets for no other reason than to damage 3rd party chances even further.

Actually, it is all about the Founding Fathers- specifically, these founding fathers.

Imagine if you had a job where you can run around the country blabbing about whatever and have people throw money at you and feed your ego.

As bad as the 2 “major partys” are, I believe there is some cosmic force that makes people insane when they run in 3rd parties.

If and this a big if, a nominee would still need 269 electoral votes to win the Presidency. If neither has 269 then it goes to the House[or the senate] to decide. The media of course would support their candidate obie but the republicans would break out of their silence and there would hellraising across this country. Remember after Florida when the right stood up.

All they had to do was meet a simple filing deadline and they failed.

So it's simple to go back in time? Cool, did not know that.

The Texas law stipulates that this year they had to certify and file by Aug 25th, although the Conventions were set for later than that date. So, the parties either had to move their conventions forward to meet the deadline of one State or they had to figure something else out.

And they did.

Both parties filed the certification paperwork to meet the ballot requirement and then amended their filing after the nominations were official.

Amended paperwork filed on time. Ain't bureaucracy grand!

It's like filing your estimated taxes on April 15th, but filing for an automatic extension. Then you get until August 15th to file your actual form and pay your taxes.

Must suck to be a member of a Party that doesn't even know how to work around red tape.
