Berg should hardly be surprised that the defendants filed their Motion to Dismiss on the last day that they could. I've predicted that they could easily stall out this case until after Election Day. It's an easy and effective strategy for the defendants. After Election Day, the issue of Obama's constitutional eligibility becomes moot if he loses. If he wins, Berg would be forced to amend his complaint due to the new circumstances, which would draw out the case through Inauguration Day. And once sworn in, it seems likely that no federal court would assert the authority to remove Obama from office; the only legal remedy for his lack of qualifications would be impeachment.

Berg also claims Obama was born in Kenya, yet unfortunately has no evidence to prove it. He needs to get a Kenyan birth certificate and/or affidavits from people who were in Kenya and know about Obama's birth there in order to prove his point.

Circulate petitions demanding that Obama present his genuine credentials.
