It would necessarily be moot if Obama loses.
Obama would be guilty of massive fraud, unless it could be established that he didn't know he wasn't constitutionally eligible. (Heck of a note for a US Constitutional Professor!) He has defrauded the Democrat party, the American people, and anybody else who in good faith donated money to him. (And don't forget the Illinois Bar Association & the State of Illinois for his law license!)

Fraud, yes, but unless Berg lived in Illinois or contributed to his campaign, he would have no standing to pursue the lawsuit and it would be moot as to him. A lot of people might have such a claim again Obama but I don’t believe Berg could sustain it if his standing is based solely on being a U.S. citizen. Besides, if he loses such a case, I suspect he will be judgment-proof.
