In the continuing saga of the Berg lawsuit; yet again ANOTHER motion is filed; this time in Utah

Another intervening motion was filed today in the ongoing federal suit against Barack Obama. This motion, filed pro se by "U.S. Citizen and voter" Judson Witham of Provo, Utah, is the third such motion for leave to intervene filed in this case. As I mentioned when the others were filed, I feel as though we should continue to focus our attention on the case-in-chief.

Counting this and the other two intervening motions, there are now nine pending motions in the Berg v. Obama action. The others include Berg's motion for expedited discovery, Obama and the DNC's motion to dismiss, Berg's opposition to the motion to dismiss, Berg's motion for leave to file amended complaint, Obama and the DNC's motion for protective order, and Berg's response to the motion for protective order.

Just a reminder -- despite the perceived delay, the Hon. R. Barclay Surrick is well within his discretion here, and may very likely hand down an order (possibly addressing all pending pleadings) this week. Or he may not. Please continue to check America's Right for updates.

Why does he go to great lengths to not show his real birth certificate?

Either he is eligible or not but the media should be looking into this and asking these questions.

That way the rumour gets out to bed or the story is real and he is not able to be president.

Well, i had a daydream that the court will hand down a decision stating that the plaintiff has made out a prima facie case, and will explain in his decision the theories pleaded by Berg that allow one to draw reasonable inferences that boobama is not a natural born citizen and therefore the motion to dismiss is denied, discovery shall proceed, the defendant must produce the requested documents. Sounds good to me. :)

Is there anything in the law that gives an ordinary citizen the right to demand that a candidate for any office "prove" anything?

If this is allowed to go forward, can't we expect these suits in every city and state against every candidate? Are lawsuits normally allowed that demand information to disprove rumors? Who decides that a rumor has merit?

Prove you're American.

Prove you're really old enough to hold office.

Prove you've never been convicted of a felony.

Prove you've lived in the state (county, city, town) long enough to qualify.

Prove you're a registered voter

Prove you aren't from Mars.

It could (and no doubt will) go forward like this forever if these sorts of things are allowed.

There are 60 states. Obama said he had been to 57 with one to go and that he wasn’t going to HI or Alaska and makes 60. 10 of them apparently don’t do polls though as we have not heard how the election is doing in those 10.

The fact that the Washington TImes has picked up the legal action signals that others will also soon become involved and the MSM cannot ignore it any longer. Besides Berg’s action in PA there are also actions in Utah and Washington State...only 54 more to go if you use Obama math.

I never cease to be amazed that no Democrat was concerned that their candidate is so ignorant about the real America that he didn’t know how many states there are!
