In reading this thread I’m reminded of the copious number of bureaucracies staffed substantially by Leftists’ within our Government’s overall system. With that said it’s easy to understand why nothing gets done about this topic.

so if some Office raked McCain over the coals because of his being born in Panama, why didn't they follow suit with Obama? Were they not aware his mother was pregnant with him in Kenya sortly before returning to Hawaii? If they treated Obama diferentially, there would be an "equal treatment under the law" suit here IMO.

With all this dicussion going back and forth, it would seem to me that the secretary of state of any state could challenge a candidates qualifications if they are in question. Obviously this would require a republican secretary of state to initiate. It will also have to done qickly.

The left and their media allies howled over McCain’s birth status and he voluntarily responded with the documents. That’s the double standard and hypocrisy we’re seeing over the whole issue and it’s being done with GOP silence.

Even at best, if Obama is disqualified after the fact, Biden becomes the President elect, or President. If President, he nominates his vice-president, and the Congress rubber stamps that.

I wonder who Biden would select. That would be a nightmare scenario also.

to get on the ballot in each state I recall there is a number of signatures required, and is therefore the vetting process for Constitutional eligibility also conducted by each Sec of State?

Why should anyone have to bring a complaint before a government body? If the guy can’t show that he is a citizen, he cannot serve as President, period. There has to be some government body that oversees this.

Do we wait until he is elected, then challenge him in a district court?

This was the expected “motion to dismiss” response from the FEC, doesn’t change the lawsuit in any manner. The Judge hasn’t made any decisions regarding the FEC or the core case against Obama and the DNC.

Not that I know of. There are qualification requirements for obtaining matching funds, but I don't think that set of qualifications includes the question of qualification for ballot access.

It's an interesting issue on yet another level. Technically speaking, the people vote for electors in their states, and not for the candidate. It's the electors votes that must go to a qualified individual.

Isn't this thread about the FEC saying "we (the FEC) lack jurisdiction"?

Unrelated to this specific issue, but in election contests, the voters lack standing to sue for recounts.
