It is a VERY BIG NO-NO if the docket clerks do not scan the docs into CM/ECF. It may take a day or two but they will get in. They must be in the case management system or else!
That truncated docket I posted was obtained just this morning. ZERO of the documents (and you can see the docket goes back to August 21) are available online.
Obviously, the documents are "in the case management system," seeing as how their identification and description are available online.
I'm very curious to know if this case is an anomaly in that regard, first in Judge Surrick's courtroom. I suppose I could pick a few cases at random and check.
The good judge probably doesn’t do his own typing. I could see a scenario where his clerk or secretary types in the final edits at another location and faxes it to him, and he signs and refaxes the final decision.
That said, I could see the words being his, but buy into all sorts of corrupt, politically motivated judicial behavior. I just don’t see this as proof. Anywya, someone should be able to check the other FAX number.
That’s really weird because an Ohio paper was reporting that Judge Surrick had ruled in favor of Berg and that Obama’s name had to be taken off the ballot, in yesterday’s Xenia Gazette and has been removed. The article about the report is at the following address. Funny, when I just went onto the link below it came up with a flag saying that my IP address was blocked. Be quick and jump on to see it before THAT disappears too: http://brianakira.wordpress.com/2008/10/25/is-this-for-real-judge-orders-obama-to-be-removed-from-ballots/
US District Court Judge Honorable R. Barry Surrick has ruled that Barack Hussein Obama was not a natural born or naturalized citizen and is ineligible to run for and/or serve as President of the United States.
Judge Surrick then ordered the Democratic National Committee to cease all campaign activity on behalf of their candidate for President. He further ordered Obama be removed from all election ballots.

BUMP!!!
bkmk
Reporters are not the more intelligent part of the population. Probably below average, on the whole. One of them took the proposed order by Berg as having been endorsed by the judge. But anybody whose been around litigation knows that the parties routinely offer proposed orders for the judge to sign, so by going through the papers one could just as easily find a proposed order by the Obama side.
Someone needs to FOIA, PIR the Fax logs, Phone records, emails, etc...
Interesting.
BTTT
And why almost simultaneously were all of the docket links disabled on the case in PACER

What is PACER?
What is a docket link?
Why is this important?
