Given the stooopid cases that have been in front of the courts, this one seems to be far from frivolous, and actually has direct bearing on....wait for it.... the clear reading of THE CONSTITUTION! This is not "legislating from the bench", this is ACTUAL INTERPRETATION of what the document really says. I say, go for it.
