Could you imagine what would happen if this was actually taken up as a case and if they HAD to rule against obama. The moonbats would go ballistic ... and the Supremes don't want that to happen.
It's going to conference, so I'd say there is a good chance of it being taken up sionce there is a serious constitutional question involved. Even if it doesn't go forward, expect at least three justices to issue opinions addressing why it should be heard. Those will get widespread notice.
If it is heard, expect a 9-0 decision against Obama if he cannot establish that he is a natural born citizen. The constitution is very clear.

How do you know this?
All the SCOTUS has to do is rule that all the candidates produce their vault Birth record. If it proves that Obama is a citizen then that is that. If it proves he is not a citizen then a crime against the USA will have been commited ... and it will be Obamas fault not the SCOTUS.
What if they don’t take the case and down the road we find out he WAS born in Kenya? Talk about a nightmare. The Supreme Court would lose ALL credibility. It is their job to make sure the Constitution in followed, do you think they want the biggest fraud ever perpetrated on this country in their lap?
In this day and age, NOTHING stays secret. Any person who could come up with any documentation to show he was not a citizen or ineligible would more than get their 15 minutes of fame, they’d be in history books.
This story and these questions aren’t going away. Even if the USSC dodges this bullet, there will still be the question of Obama’s legitimacy looming. Do you really think that half of the country will just sit back while a possible foreigner runs/ruins the country? I’ve been predicting another civil war for years now. I was, however, kinda hoping that we conservatives would be the ones “in power” when it happened. Looks like that will not be the case.

If this were to process through the SCOTUS, the end result would only be the complete destruction of the United States Constitution in order for the Libs to have their way. Can you even imagine what that would be like?
Methinks that behind those closed doors, Justice Thomas is going to make clear that no matter what happens, moonbats from some side are going to go ballistic - and not just figuratively. This is why Constitutional crisies are to be avoided early, and not let such such BS sneak in under the radar. If this thing isn't addressed, it's not going to just go away.
I will go out on a limb and suggest that the Supremes will rule it's a state issue, not a federal one. I base this on the fact that, outside of the EC meeting, there is no federal election of the president, it's all done at the state level.
I would be very surprised if they demand proof of eligibility. While there is a constitutional eligibility test, the document does not say who has the authority to check up on it and do something. The tenth amendment likewise gives a hint of what direction they are likely to take.
While this is all very frightening, it's pretty entertaining too.

They will say, "Why was this not discovered before the election? It must be a desperate last gasp from the GOP."
After all, the people have spoken decisively. Blacks are almost unanimous. Whites voted to punish Bush. Jews voted to abandon Israel. Muslims voted the obvious choice. Atheists and abortionists voted the obvious choice. Communists and socialists voted the obvious choice. The entire WORLD voted for Obama.
A perfectly legal, computer printed birth certificate will be produced. Logical explanations will be offered. The One is about to rule.
They better make sure the Constitution is upheld. I certainly do think they’ll take the case.
Why is it that everyone who posts this theory never imagines that the reverse might happen if the SC decides in favor of Obama?
Don't doubt for a moment that the Supremes are between a rock and hard place with this. Even if they somehow weasel out of making any decision at all, it will be viewed by millions of Americans as an abject dereliction of duty on their part.
And if the SC is too cowardly to enforce the rule of law and our very Constitution, then what right does the federal government have to enforce the same upon us, the law-abiding, taxpaying citizens of America?
Trust me, there is going to be an uproar no matter which way this goes.
