Prosecutors ask for one murder charge to be dropped (AZ 8-yr-old boy)

ST. JOHNS - In a motion filed late Friday, the Apache County Attorney is seeking the dismissal of one of the charges against an 8-year-old boy who is accused in the shooting deaths of his father and another man.

They have asked that the first-degree murder charge stemming from the death of the boy's father be dismissed although the motion explicitly allows the refiling of the charge if it is granted. The boy is also charged with first-degree murder in the death of 39-year-old Tim Romans, his father's roommate. The prosecutor's office wouldn't explain its actions. A strict gag order for individuals involved in the case remains in effect.

Bet it has something to do with this.

I wonder if the roomer killed the father, so the boy killed the roomer with the same gun???

I heard the tape of this kid. He really sounded like a scared kid. I would be amazed if he actually did it. Interviewing an 8 year old by himself (without competent council) is just plain dumb. So is charging him as an adult.

This really pisses me off. You would think that the police and prosecutors would know all of the rules for such things by now.

I think Dad and Roommate were more than just roomies, if you know what I mean.. this poor kid knew no other way out of this sick situation.

I pray for this child. My oldest son is eight and I know this boy must be scared to death. May God comfort and keep him. I am sure there is MUCH more to this story.

I haven't kept up with all the stories on this. Here is another article from the Independent:

"The gag order was processed and issued Monday morning while several hundred mourners filled St. John the Baptist Catholic Church, inside and out, to pay their final respects to Vincent Romero, 29, who died last Wednesday from gunshot wounds allegedly inflicted by his son.

The gag order directs all those involved in prosecuting or defending the case, law enforcement, child protective services, probation and detention agencies, and the attorney general's office, "... cease immediately from disseminating any information, views, predictions or commentary regarding this case." Roca said he believed the gag order was necessary because he is also hearing a custody matter concerning the boy and he doesn't want the case contaminated with inaccurate rumor and speculation.

Roca allowed two attorneys who represent news organizations in the Phoenix area to participate telephonically in a Monday afternoon status hearing. Attorneys Daniel Barr with Phoenix law firm Perkins Coie Brown & Bain, and David Bodney with Steptoe & Johnson, asked the judge on behalf of their media clients to reconsider and modify the gag order believing the order "swept too broadly."

"One of my concerns has to do with the potential contamination of the dependency proceedings by essentially loose cannon pronouncements by various individuals quoted at length and in detail and with a substantial lack of accuracy as far as what is happening and what is going to happen and their effect on those dependency proceedings," said Roca. "I was surprised this morning to find that the proceedings in this court were being described inaccurately on National Public Radio, if you can believe it, by way of quoting The Today Show."

St. Johns Police Chief Roy Melnick appeared on The Today Show in a live interview Monday morning with show host Meredith Vieira."

I’m afraid that the truth of this story won’t come out until the trial, if then. It may be that the whole thing will be censored to protect the child.

There was a father, his wife, and the child in the home. The "roommate" was a co-worker of the father who had rented a room from them.

I wouldn't jump to conclusions.

I knew St. Johns somewhat many years ago. It was a very decent town split between the more numerous Mormons and a large Hispanic, Catholic minority. It is very surprising to hear this about this town but the world has changed in the last 40-50 years. Still, I would trust the good people there to sort things out if they were able to without an outside circus. Hopeless wish.

No, the whole thing will be sensored to protect the deviant homosexual community. After all, sodomy is a right and it is normal according to the powers that be. All of us who supported Prop 8 are bigots don't ya know.

Same exact thing is going on with the Metro passenger train crash in the San Fernando Valley (Los Angeles main suburb) taht killed over a couple dozen people.

We CANNOT call these people mentally ill, we cannot remove them from public safety jobs because this mental illness is now a legally protected and santioned right. 2 daddys are just as good as a mommy and a daddy, isn't it?

You are welcome to your opinion, however I have seen no proof whatsoever that there was a homosexual relationship.

I wouldn't care to slander two dead men based on no evidence whatsoever.

This is the first story I read as regards, and the only one I've seen mention anything about possible abuse, most I've read later are about the kid having access to the weapon:

ST. JOHNS, Ariz. – Police in this small eastern Arizona community are looking into the possibility that an 8-year-old boy who is charged with killing his father and another man with a rifle had been abused, the police chief said Saturday.

Just wondering if this particular reporter got something from the police chief that he didn't intend out. If anyone else has a link to a story with abuse a possibility, motive, I'd like to read it for comparison.
