You are exactly right! No one in authority was willing to question this when Obama was a candidate for the same reasons that you cite. Now that he is president elect, they will be even less willing to do something about it.

Because of this reality, pushing this issue only makes conservatives look like petty sore sports. It is a losing issue all the way 'round.
