Kenneth W. Starr, the former U.S. Solicitor General who led the inquiry into President Bill Clinton’s affair with Monica L. Lewinsky, will argue the case in favor of upholding a ban on gay marriage before the California Supreme Court.
Starr was today named lead counsel for the official proponents of Proposition 8. This afternoon, the group filed court briefs defending the legality of the proposition, which was approved by 52% of California voters last month throwing into question thousands of marriages performed during the five months the practice was legal in the state.
The briefs are in response to a spate of legal challenges filed by gay rights advocates, including the cities of San Francisco and Los Angeles.

Hell, we just lost the effort. Ken will get lost on his way to court.
It's not "Prop 8" any more, it's a part of the California constitution. State courts have to uphold their state constitutions, not void it. Are they going to declare their properly-amended constitution "unconstitutional"?
Plaintiffs should have been laughed out of court, and the groups that successfully amended the state constitution should not be forced to defend itself again against this ridiculous suit.
But "everybody knows" a judge is superior to the state or federal constitution he swore to uphold.
What’s to defend? The law is the law. We don’t need any champion to take up our cause and pretend the matter needs further debate by our betters in some courtroom. The only question remaining is whether the rule of law still governs, the state constitution is still worthy of the name, and the people are still sovereign - or whether judges are now co-regents ruling over Californians.
I say wait in silence to see whether these judges will submit to the law and whether the executive will execute it. And if they won’t, march en masse on the governer’s office and demand that laws be enforced, and march on the capitol and demand the removal of usurpers and lawbreakers from the bench.
A lot of these “grand attorneys” are like trying to swim after substituting an anchor for your life preserver. Their job is to throw the game, while making it look like they’re working on your behalf, yet without leaving evidence of having thrown the game.
Starr, especially. If you were truly hated by the government, like Timothy McVeigh, and being defended by some mall lawyer who worked out of a trailer, Ken Starr would show up to “take over” and work pro bono for you. Everybody would be so in awe of him, that they would agree.
However, you might have a chance with the mall lawyer—you won’t with Starr. It’s his job to make sure you end up in the electric chair. The mall lawyer might accidentally hit a home run and get you acquitted, and that can’t be permitted. And the government does not like leaving such things to chance.
Look at Bill Clinton. A mall lawyer prosecuting him could have had Bill wearing county pajamas before sundown, probably facing 200 counts of the most heinous crimes Bill committed. Instead, good ol’ Ken Starr would only charge him with a charge so stupid and embarrassing, it would guarantee he would walk. And Ken Starr also ran up the tab and ran out the clock in doing it.
They kept bragging about Ken Starr’s “attention to detail”, which mostly amounted to him keeping precise tabs on his expense accounts.
8 is going down. I know a setup when I see one.
I look forward to reading the arguments. The pro-Prop 8 folks asked Kenneth Starr to represent them. This is going to be quite the case to observe and study; and it will be high profile. This is good.
Some learned quite clearly, that after CA's Prop 209 was passed by majority; local governmental bodies declared they were NOT going to obey parts of the state's constitution they, personally, disagreed with. D-Bill Lockyer is quoted saying exactly that, back then.
And in fact, local public entities had to be taken to COURT in order to enforce the State Constitutionality of Proposition 209.
Over. And over again.
Supporters of Prop 8 need to find out where to begin, immediately, sending financial support to in re lawyers defending the state's constitution.
I suspect Barack's people have already decided who will be the legal shadow group of the anti-Prop 8 legal team. Former President Clinton used the Office of Civil Rights Commission as such a shadow support to fight Prop 209. And, BO's line-up appears to be happening quite quickly. It's really just slightly different, tactically, from Bill Clinton's.

I don’t know how they can do that. That’s why it’s a constitutional amendment, so that the court cannot throw it out.

“It wouldn’t surprise me if the California Supreme Court threw out Proposition 8. The vote of the people don’t count for much in California, if the elites don’t like the way they voted. And they don’t.”
The same for the rest of the country too. The courts and our “elected” officials don’t give a dang what we serfs think and want. The only use we serfs have to them is to pay taxes (whatever amount the elite think we should), pay their salaries and perks, and feed their narcissistic egos by having power over us.

This man is one of the few in our time with intestinal fortitude, otherwise known as “guts”. He took the flack for trying to bring Clinton to justice. The guy is brave. He’s right, too, again.
