There's an assumption here that the homeowner was not otherwise engaged in any unlawful behavior. Let's say he was growing marijuana in his closet.

Maybe he had some crank cooking on the kitchen stove.

It's quite possible the police have probable cause to investigate all sorts of things.

We still don't know enough to make a full judgment in this case.

Looking at the specific law it's talking about entry into the dwelling, not just the property, so whether he was in the front yard, backyard, or out on the sidewalk, HE WAS NOT INSIDE!

You may want to revise this law so you can shoot 'em down at the lot line or something, but in the meantime the case has to focus on INSIDE THE DWELLING.
