I Want The House, The Kids And The Kidney!

A Long Island man's quest to end his messy divorce took a new turn this week as he demanded his estranged wife give back the kidney he donated to her in 2001.

It's a touching tale and one that has been met with ridicule from area divorce attorneys.

"She ripped out his heart, but he doesn't get to rip out her kidney," says Lisa Bloom, a legal analyst for CBS' The Early Show.

Calling this a publicity stunt by the scorned husband, Dr. Richard Batista, Bloom says there is absolutely no chance his soon-to-be ex-wife, Dawnell, will have to give her new kidney back.

"He wants his pound of flesh," Bloom said, but "he's not going to get it by way of the kidney."

For his part, the doctor said he would accept $1.5 million in compensation. He's also said that despite his marriage crumbling and a strained relationship with his three kids, he does not regret donating the kidney.

"There is no greater feeling on this planet. As God is my witness, I felt as if I could put my arm around Jesus Christ. It was an unbelievable; I was walking on a cloud.

To this day I would still do it again."

If he didn't feel that way, he'd have gone insane. It's a consolation mechanism to comfort him into accepting the fact that he will never be able to get back his kidney again.

Wewll, that sure is a nice way to say the ex-wife had been cheating on him for some time, and refuses to give him visitation. The ex wife seems like pure evil.

I wonder if the wife knew she sould need a kidney eventually and ascertained the good doctor’s compatibility before marrying him.

Last I heard, selling organs was still illegal in this country. The state medical board should yank this idiot’s license for a few years, and make him get psychiatric treatment before he can get it back.

Actually, the marriage accumulated two good kidneys, so the wife is entitled to half.

Possession is 9/10ths of the law...at least what I have always been told. This guy needs to cut his losses now, at least he has only lost his kidney. He stands to lose an arm and a leg.

I think that the guy should be compensated somehow. He gave His kidney within the context of his family, for his children's mother and for his wife. She accepted it in that context. This why a marriage must once again be recognized as a contractual agreement. Then each party has rights. With 'no fault' nobody has any rights.

Since he alleges that she cheated on him, that might get him out of alimony altogether, or at least limit it. I can see him trying to play on a court's sympathy, but asking for the organ back has just the opposite effect.
