Jamie Gorelick Defends Her FISA Record at Justice (Well Gorelick, you failed to keep America safe!)

Your inaccurate swipe at my record ("President Gulliver's Lawyer," Review & Outlook, Jan. 10) demands a response.

First, the March 1995 memo I wrote about the Foreign Intelligence Surveillance Act did not set policy for the Justice Department. It resolved a particular problem in the WorId Trade Center bombing case, which was that the U.S. Attorney wanted to use a FISA warrant to tap individuals who had already been the subject of criminal wiretaps -- something that had never been done before and which the Justice Department's Office of Intelligence Policy feared the FISA court would not permit.

I was asked by the U.S. Attorney and the Office of Intelligence Policy to sign an agreement that they had negotiated to permit this extraordinary step, in the hopes that if I vouched for its compliance with FISA, the FISA Court would permit the arrangement. The memo I signed was an aggressive use of the FISA power not, as you suggest, one that shrunk from utilizing all of the government's power to protect against terrorism.

Well it is interesting that Jamie Gorelick decides now to comment on this. She could never be bothered in the prior decade-plus when it might have elevated visibility of her as the person most facilitating the terrorist acts in the US including 9/11 (as during the 9/11 panel enquiries).

It was stunning for her to be allowed to sit on the 9/11 panel passing judgement on others.

I can only assume that her 24 million from “helping” the failed Fannie Mmillions is larely spent and she has more money to make and power to assume in the new Obamanation. But apparently she needs to get over the minor bump in the road to max her bank accounts and to build a few more intel walls.

Her response came after the FISA Court ruled the Bush program was legal. Her failing to do what Bush did makes her responsible for failing to protect America by use of any legal means. After the first World Trade Center Strike she should have been doing what Bush did but she was too busy covering up Clinton's sorry ass, literally.
