No state has anything in its respective Constitution that allows for legal secession. This is a urban legend, especially in the case of Texas, that simply refuses to die.
I believe it was Montana just awhile back the used this defense, should the U.S. violate the Constitution under which the State joined the union the state would break it contract with the U.S....
of course the U.S. would fight it but would it actually go to war with a state that pulled out... in this day and time I don’t think so.
Well, not that I think any state has the gumption to secede, but as regards the “right”, I have my take on that.
The federal Constitution is trashed and generally ignored by all liberals and too many of the other folks when it doesn’t suit their current agenda. IMO, the fact that the federal government and the SC regularly perform blatantly UN constitutional acts, voids any “contractual” obligation on the part of the states. IOW, if the Constitutional rule of law does not apply to the Federal government (and it certainly does not) then the states are not bound by it to stay in the union.
No state has anything in its respective Constitution that allows for legal secession.
That may be, however. . .
The Declaration of Independence and principles therein are codified law of the USA.
As the Republics last bulwark, it is the citizenrys duty ensure enforcement.
Subsequently, the 2nd Amendment is the vehicle necessary to exercise our God-given right to quell a tyrannical, destructive, profligate Federal government.
Liberty can be such an ugly pursuit.
