Rangel’s Financial Disclosures Omitted Data Over 30 Years, a Report Says

Representative Charles B. Rangel’s financial disclosure forms had at least 28 omissions in the past 30 years and failed to account for what became of more than $239,000 in assets, according to a report issued Wednesday by a private government-ethics group.

Despite Congressional rules that require members to list the purchase or sale of any assets, Mr. Rangel accumulated from $239,026 to $831,000 in assets that were not listed in subsequent reports, according to the report by the Sunlight Foundation, a nonpartisan group that advocates greater transparency by elected officials.

In some cases, Mr. Rangel listed assets without stating when he acquired them. For instance, his disclosure form for calendar year 2006 lists 13 mutual funds with values from $54,013 to $286,000 but omits any acquisition date.

Mr. Boehm said that after he became concerned that the congressman may not have reported all the rental income from the Dominican villa, he discussed the matter with a Post reporter. Mr. Boehm said he helped the reporter later with articles about Mr. Rangel’s joining an overseas trip that had been underwritten by corporate donors and about his use of a homestead tax credit in the District of Columbia that members of Congress are expressly forbidden from claiming.

“All we have asked of the congressman is to tell the truth,” Col Allan, editor of The Post, said on Wednesday. “We stand by our reporting.”

WHEREAS, The New York Times reported on September 6, 2008 that, “Representative Charles B. Rangel paid no interest for more than a decade on a mortgage extended to him to buy a villa at a beachfront resort in the Dominican Republic, according to Mr. Rangel’s lawyer and records from the resort. The loan, which was extended to Mr. Rangel in 1988, was originally to be paid back over seven years at a rate of 10.5 percent. But within two years, interest on the loan was waived for Mr. Rangel.”; and,

WHEREAS, Representative Rangel’s failure to disclose the aforementioned gifts and income on his Personal Financial Disclosure Statements violates House rules and federal law; and,

WHEREAS, The New York Times reported on November 24, 2008 that, “Congressional records and interviews show that Mr. Rangel was instrumental in preserving a lucrative tax loophole that benefited [Nabors Industries] an oil drilling company last year, while at the same time its chief executive was pledging $1 million to the Charles B. Rangel School of Public Service at C.C.N.Y.”; and,

WHEREAS, Roll Call newspaper reported on September 15, 2008 that, “The inconsistent reports are among myriad errors, discrepancies and unexplained entries on Rangel’s personal disclosure forms over the past eight years that make it almost impossible to get a clear picture of the Ways and Means chairman’s financial dealings.”; and,

WHEREAS, nearly five months after Representative Rangel pledged to provide a public forensic accounting of his tax and federal financial disclosure records, he has failed to do so; and,

An out and out criminal offense. To date, cabinet nominees have been allowed to pay their tax and either get confirmed or quietly withdraw. Here is a case for prosecution. If he is not prosecuted, we all knows where Obama stands and its a free for all of tax evasion.

Rep. Charles Rangel (D-N.Y.) is facing new questions about why he has not disclosed any royalty income on his 2007 memoir … And I Haven’t Had a Bad Day Since: From the Streets of Harlem to the Halls of Congress.

The Sunlight Foundation, a nonprofit, nonpartisan advocate for government transparency, wants to know why the chairman of the powerful Ways and Means Committee has failed to report royalty income and has not voluntarily disclosed details of his book contract.

Sunlight senior fellow Bill Allison noted that Rangel’s book has already been published in paperback form, usually a sign that the hardback version sold enough copies to merit a second publishing. Rangel’s contract is with Thomas Dunne Books, a subsidiary of MacMillan.

While House ethics rules don’t require the public disclosure of book contract details, they do require members to report all outside income, including book royalties. The threshold for reporting is $200 for outside earned income.

Allison said former Speaker Dennis Hastert (R-Ill.) and other prominent lawmakers have made their publishing deals public to avoid any appearance of impropriety.

“Before the book came out he should have announced the arrangements he made with the publisher,” Allison argued.

Since 1995, House rules have prohibited members who pen books from receiving advances. The rules, however, allow regular royalty payments if the ethics committee approves the book deal beforehand.

Rangel left out any reference to the autobiography on his financial disclosure forms so it’s unclear whether he received any money for an advance or in royalties, or whether the ethics committee approved the deal. The ethics committee and individual members often correspond privately, so the committee may have given him the go-ahead.
