Court records: Husband shot wife during intruder game

LINCOLN — Twenty-one-year-old Josh Beasley was pretending to clear his home of intruders on Saturday when he fired the shot that killed his 20-year-old wife, Alaina, according to court documents filed today.

The affidavit, based on Beasley’s interview with a Lincoln police detective on the day of the shooting, was released by Lancaster County Attorney Gary Lacey.

Josh Beasley appeared in court this afternoon on a charge of manslaughter for unintentionally causing his wife’s death.

With about10 friends and family members in the courtroom, Lancaster County Judge James Foster released Beasley without bail. Beasley had turned himself into police this morning.

In an interview with the World-Herald, Beasley earlier said he accidentally shot his wife while cleaning his shotgun.

He rounded the corner into the kitchen, where his wife was standing near the sink. She pointed her hand at him, pretending to have a gun. According to the affidavit, Beasley said he raised the shotgun to his shoulder and fired one round. He said he had forgotten the gun was loaded.

1. All guns are always loaded.
2. Don’t point the muzzle at anything you’re not willing to destroy.
3. Keep your finger straight and outside the triggerguard until you’re ready to fire.
4. Be sure of your target and what lay beyond.

What a friggin’ idiot. A beautiful young woman dead and his life ruined.

If this statement is factually true then he is guilty of premeditated murder.
Anyone that handles a weapon must always assume that it is loaded.
You never point at anything you do not intend to destroy.

The old "playing Army" defense.

Unfortunately, this happens in police training also, on occasion. I believe in RTKBA, but some people just shouldn't have guns. Just like some people shouldn't drive cars or own a chain saw.

I don’t believe it. Will the police believe this cover story? I think he murdered her.

This is real close to the young man that was going to be a deputy and killed his wife practicing his quick drawn. Both are Darwin candidates.

TUALATIN, Ore. — “A man who signed on to become a Clark County sheriff’s deputy accidentally shot his wife to death in Tualatin on Sunday, according to police.

Police said Ryan Osbrink, 24, was practicing drawing his pistol from a holster when it unintentionally discharged as his wife, Kimberly Osbrink, entered the room.

Sounds like just a very tragic accident. Theres this school of thought that every accident has to be punished as thought here was a homicidal intent. It’s pointless and silly.

And changing the story from something like “i was cleaning it”, to i was playing “clear the house” and forgot it was loaded, seems to be reasonable. It makes him more culpable, so its setting the record straight from his panicked cover story.

IMO,,if his background is otherwise very clean, prison isn’t what he needs. He needs to be sent to schools, CCW courses, Police Academies, etc,, to tell his story to people who handle guns a lot, and to young kids.

I think this is genuinely an accident, based on his immediate call for help and that he turned himself in to police. Accident, but...

A f@#&ing STUPID accident. You NEVER point a firearm at anything unless you are prepared and preparing to kill it. I had a friend/roommate once who pointed a shotgun at me as I walked through the door. He later said he was just joking and wanted to scare me. That was after he was thrown against the wall, disarmed and butt-ended with it.

A firearm needs to be respected and assumed to be loaded at all times. Not just by the gun owner, but by everyone who comes into your home and looks at or handles your weapon. God, what a terrible mistake - one moment of stupidity for this kid and his wife is gone. The inevitable use of this by the anti-gun crowd is going to make me ill.
