16 illegals sue Arizona rancher

An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday....

"This is my land. I´m the victim here," Mr. Barnett said. "When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back."

This country is technically AT WAR. Why aren’t these illegals charged with espionage and hanged for sneaking into this country??

My guess is that, technically:

1. this country is not legally at war with Mexico, and even if it was,
2. these people do not meet the legal standard of being spies.

To top all that, the legal standards for hanging a convicted spy must be rather difficult to meet. When's the last time the U.S. has hung a spy? I don't even know.

No, the main question is, why is this even in a court of law? They gave up their “rights” when they violated his!

I think people fail to read the “illegal” part of this entire story! They are ILLEGAL aliens who were on his property ILLEGALLY! To me the rest is immaterial!

Just my opinion!

Already happened a few years back. A rancher held some illegals for the BP and HE was arrested for kidnapping. I'm not sure about the criminal case, but the ILLEGALS sued and WON his ranch( I think around 600 acres). He is now homeless with a criminal record.

I’m just stating my understanding of Arizona law, not that I agree with it. We had a similar discussion years ago when the Minutemen were starting up - some folks wanted a more aggressive approach - active apprehensino, but in AZ the law regarding citizens arrest is not conducive towards such - so the Minutemen were smart and stuck with observation and reporting.

No, nothing personal to you. I was simply stating as an overview - what part of ILLEGAL don’t people understand?

I mean like you said, the laws are written to actually be in FAVOR of the criminals! WTF?

This guy has held 12,000 illegals for the BP over the past ten years. I think he should sue the US Govt and Border patrol for failure to protect him and his property.

Unfortunately, the SCOTUS has supported local governments rights to use eminent domain to seize private property. Watch some crazy local govt officials down there to seize this guys ranch and make it a safe haven for the illegal aliens.

If the criminals win (which isn't out of the realm of possibility), the message sent will be: cross the border illegaly, commit violent crimes against U.S. ranchers, and you can win the lottery too! ....and that message will be loud and clear.

Somebody needs to help me out here.

If a natural born US citizen cannot contest the results of a fraudulent election in court (Berg, D’Onofrio, et. al.) then how does a non-citizen get “standing” to sue anybody for anything?

If it were me, as soon as my attorney had their names I would counter sue for trespassing, property damages, and stealing.

Greetings all:

With a friend who is a good friend of the rancher being sued, I attended that trial in the US Federal Court Building in Tucson, Thursday Feb 5th. During a break I asked the attorneys for the Illegals, if they were now in the country legally. One wouldn't talk to me and another did say they were here legally, (so they can be at the trial) (there are 5 attorneys working for the illegals) Those attorneys complained to the Judge that I was asking questions. Then the judge apparently told the U.S. Marshals, who have a big office in that federal building in Tucson, to "ambush me" if I showed up at the courtroom Friday! For what?? Can you believe that?!!! What is happening in our country?

During cross examination of the gal who was supposedly assaulted, it is obvious there is absolutely no physical evidence that Roger's dog bit anyone, nor that Roger kicked anyone. What a bunch of BS. It is appalling. It makes me very angry.
