2nd suspect in USC fatal out on bail

LOS ANGELES (KABC) -- The second suspect in the hit-and-run crash that killed a USC student is out on jail. "At this point I do not understand our justice system," said Carmen Bachan, mother. Carmen Bachan is grieving and frustrated. Her 18-year-old daughter, Adrianna, was killed in a heinous hit-and-run. Fellow USC student Marcus Garfinkle was critically injured. Now just one of the suspect's who was just arrested is free on bail.

Who with the wire services proofs this stuff? You can be out of jail, you can be out (of jail) on bail, but you can't be out on jail.

Luna and Cabrera. I’m sure they’re here legally. /Heavy sarcasm.

I used to live and shop near there. Not the best area for what is or used to be a good school.

Mostly a black and hispanic area now. Say, didn’t OJ play for USC? I guess Luna and Cabrera took lessons from OJ.

Why, I don’t see injustice here - we have a bail system for everyone and everyone is innocent until PROVEN guilty.

This is normal SOP and while I feel sorry for the mother, I would not want anyone treated differently then I would.

“Police say that Josue Luna, 32, pulled Garfinkle off of the hood of the car after his wife, 30-year-old Claudia Cabrera, struck the pair as they crossed Jefferson Boulevard and Hoover Street near USC.”

“Claudia Cabrera was arraigned last week, but authorities have been on the hunt for her husband. He was finally arrested when he attempted to cross back into California from Mexico.”

The one released on bail is working on a theorem that will revolutionize higher mathematics. Further, this summer he is giving a seminar on philosophy. Therefore, he had to be released in order to continue his work and to adequately prepare for the seminar.

He was finally arrested when he attempted to cross back into California from Mexico.

The victim's family says that his arrest is bitter sweet. Booked on being an accessory to the crime the 32-year-old posted $50,000 bail and was released.

"The callousness and the heinousness of the crime, pulling Marcus off the car, and leaving Marcus to die and Adrianna in the street is just unconceivable. For this man to be out on bail is absolutely stunning," said John Welch, family spokesman.

Bachan's mother says it is a slap in the face and hopes that the court will revoke Luna's bail.

"I hope this animal can't go again in the streets. He has basically destroyed my family," said Carmen Bachan.

Claudia Cabrera has pleaded not guilty to felony hit-and-run and misdemeanor vehicular manslaughter, and remained jailed on $1 million bail.

Something is wrong with the bail system. He pulled the victim off the car making it aggravated, no? Can a lawyer clarify this?

And if it had been your son or daughter that this POS pulled off the hood of their car and left for dead in the street, you would have felt the same way...

The only thing dumber than the judge granting him bail was the bail-bondsman who put up the bail! This POS is history

There are more people killed by illegal aliens EVERY YEAR in America than have been killed over the past 6 years in the wars in Iraq & Afghanistan combined!

SEAL THE BORDERS AND DEPORT ALL ILLEGAL ALIENS!

Legally, couldn’t the judge have considered him a flight risk and denied bail? Especially as he was caught at the border?

(Sorry, I’m not sure how bail works exactly.)
