Supreme Court Pick Being Pushed By Democrats Thinks Policy Is Made In The Courts

founders of America designed our system of government so that policy would be created by the representatives of the people/states in Congress, with the President’s approval (subject to Congressional override) needed before any given policy is made into law. The courts were intended to simply apply law created by Congress and approved by the President to a given situation.

But the courts have long since began to make policy on their own. The states were prohibited from making abortion illegal, for instance, not through a vote of Congress but rather through the arbitrary fiat of unelected judges. That’s now how it was intended to work. But it’s how liberals like it to work. Because it’s a lot easier to impose a liberal agenda through rulings of the court than it is to muster the sort of popular support it takes to pass policy through the legislative process.

One judge that certain Democrats are pushing for Obama to appoint to the Supreme Court (ostensibly because she’s of the right skin color, as if that were a legitimate reason to pick someone) is an outspoken proponent of the sort of judiciary policy-making I describe above. I give you 2nd Circuit appeals judge Sonia Sotomayor:

“All of the legal defense funds out there—they’re looking for people with court of appeals experience. Because court of appeals is where policy is made. And I know, I know this is on tape and I should never say that because we don’t make law. [Laughs] I know. I know. [Laughter] I’m not promoting it, I’m not advocating it, I’m…y’know.”

This dingbat has no business being on any court, not even Small Claims Court. The Seperation of Powers is enshrined in the Consitution, it’s a Moral Absolute. Even before this came out, Sotomayer’s supporters admitted that she wasn’t the brightest bulb in the chandelier.

I saw the vid on Hannity tonight. Wow is all to be said. She made it clear that policy / law is set by judges....

I've come to the conclusion that this is all intentionally planned by the Rats ... to debase and confuse the culture so much that everyone just throws up their hands in disgust and says let the chips fall where they may.

We survived Carter, we are fine. Relax.

After reading The Pillars of the Earth and the World Without End, also looking at life today, I wonder if God left us a long time ago or just waiting for us to get off our ass and fix things.

The courts are making all the big decisions in Canada now, not the legislatures. Same sex marriage got the green light, but we've never had a referendum on it. Our supreme court has nine judges who are selected by the Governor in Council (the Queen's Governor General) acting on the advice of the federal cabinet.

In general, Canadians don't know who their judges are, nor who put them there, nor what they are doing until it's announced as fait accompli by the media. They have far too much power, IMHO. The old rule that parliament makes the laws and the judicial enforces them, seems to have been misplaced along the way somewhere....and nobody noticed, nor cared.

Amen, there is nothing man can do about this mess. There are some days I am convinced he is the Anti Christ even though logic tells me he is NOT. The Anti Christ could certainly make a speech more coherently than zero without his TOTUS.

Even so, she has one qualification that even you -- judging by your screen name -- will concede is an overwhelming positive.

A good friend went to high school (Cardinal Spellman) with Sonia Sotomayor. He said she was unremarkable or less as a student. Despite that fact she was able to attend Princeton and Harvard Law (I believe). She was Affirmative Action-ed to the Federal Bench and the Court of Appeals. Now the Supreme Court may await. What a country!
