I thought Rudy did a lot of great things to make New York a better place. No doubt I will get flack from some people here, I would have rather had him as the candidate instead of McPain.

Yeah, if it’s not universal, it’s near-universal, and any jurisdiction not following these rules is an outlier. I cited the common-law rules, which are then codified in somewhat different statutory language from State to State. Or, more precisely, the definition of assault is codified in different language. I don’t know how many States have specific statutes regarding self-defense, but the rule that you don’t have to wait for a battery (actual touching), but can act in self-defense upon an assault, is universal or near-universal in the case law of the States.

I appreciate the response. I think it’s an important distinction. Personally, I would have thought the ‘bad guy’ could have turned the legal tables on someone going preemptive.
I’m glad to hear an opinion that is not, or at least is not always the case.
