Sorry NinoFan, I fail to see where your optimism is coming from. She is the junior member, does not have the intellectual heft of Scalia but that will not impact Kennedy either way IMHO.

You miss my point. Justice Kennedy is easily influenced by factors other than the specifics of a case. Sotomayor is not a John Roberts kind of person who can form coalitions. Kennedy will not be influenced very much at all by her.

And so I have listened to the debates, read the notes, heard the pundits and I have, as expected, formed an opinion.

Hey, elections have consequences. And the consequence of the American public electing Obama is having this far left socialistic idealogue on the supreme court.

The thing that turned it for me was, of course, first that ridiculous ruling on the New Haven firemen case, shows you where she’s coming from. But did anybody see that sight byte....the one where she’s...la-di-da....smirking and saying...oh sure, I know we don’t legislate from the bench...smirk...smirk....

Well right there I can see this woman have visions of an America where abortions are mandatory, white folks, especially white males, are a minority and must wear a special emblam on their arms, John and Steve weddings will be the norm and all members of their towns must attend....

well I could go on.

Couple of things then I shut up. First, bear in mind that she is replacing the very liberal Souter so I’m not convinced she’ll bring much more social-liberalism to the court than Souter did. Second...what the hell people...elections have consequences. The American people voted Obama in and he has the right to nominate his supreme nominees.

The bigger question and this time I really mean I’ll shut up...is WHAT WILL THE REPUBLICANS DO?

They can filibuster this thing but we need every damn one of them. Does anybody think for a second that Snowe and her ilk will join a filibuster?

I accept that Obama got elected but I get bitter when I consider that we have no opposition party whatsoever.

Now I must shut up.

She would then recuse as there would be no support for that on the SC.
However, she will also refuse to discuss the case in the SC hearings.

That would be a great debate for America. Our loss as a result. This came into play in Obama’s throught process. I’m hoping Jeff Sessions can analyze thoroughly though her decision in the case.

If she must recuse herself, she doesn’t have any reason not to discuss her decision on the New Haven firefighter’s case.

Bottom line: she’s not sympathetic to qualified white people. She’s sympathetic to the unqualified though based on race.

Quite far from MLK measure of character, etc. not skin color. Wot a mess!

I remember Sen. Howard Metzenbaum spewing his evil when he was alive regarding SCOTUS picks. He was one of the architects of the activist court we now have.

I wonder Howard has regrets now - wherever he is.

This pick is just another godless liberal. She won't change God's eternal plan, but she will spew her evil as well. She will only bring judgement on herself.

For the liberal Democrats, appointments to the SCOTUS revolve around one major issue. Abortion. Sotomayor supports infanticide. End of story.

And let us never forget who first brought her into judicial prominence: A G*d-damned Bush!

My optimism comes from the time when Marshall and Brennan were still on the Court and the time since Roberts and Alito joimed the Court. It’s pretty well known that O’Connor and Kennedy were put off by the unfriendly nature of the two remaining lib titans. On the other hand, Kennedy has gone to the right in several areas since Roberts joiined. There is nothing to suggest that Sotomayor is a Roberts and there are a few things that suggest she is a Marshall.That is where the optimism comes from.

The qualifications that O touted for this nomination did not apply to her in a single instance. As always his talk never meets his actions.

She was the most narcissistic nominee of all time.

I missed nothing. I know very well about J. Kennedy's flaky reputation. After all, he came to the high court as a pro-life Republican. Today he is pro-abortion.

To the liberal Democrats, SCOTUS appointments are ALL about ideology. To the Dems, the Constitution is a living document, having nothing to do with originalism -— intent or meaning.

Well different lineups mean different dynamics. Not sure how much Kennedy is swayed by Roberts if at all.

Geniality is part of the court’s mindset. Scalia vehemently disagrees with Ginsberg’s approach, but he is very nice and personable with her. That’s the model of the court now.

I have no insight into the relationships on the SC or their impact if any.

I’m not concluding she’s racist. The conclusion though is that she does not have any issue with reverse discrimination.

Judges that advance reverse discrimination don’t view themselves as racist. They think they are doing some greater good. If MLK had lived, he might have stopped such a rot from entering the judicial system. Maybe.

That makes it even juicier. I’m thinking that case is going to crush her in the sense that you just know Scalia will write a scathing attack on anyone approving of reverse discrimination.

And Justice Thomas will be happy to write in agreement as well I would guess.

It will be interesting.
