Oh, I should add I love John Hart Ely’s characterization of substantive due process as a contradiction in terms, like saying “green pastel redness”.
I know it is convoluted, but it is the state of the law and what we have to work with. But even under this mess, the 2nd should clearly be “incorporated,” esp given the historical context.
