When the U.S. Supreme Court ruled last year that the District of Columbia's law barring residents from keeping loaded handguns at home violated the Second Amendment, gun-ownership advocates had reason to celebrate.
But the high court's decision could serve to bolster the other side because of its narrow reasoning, which leaves states broad authority to enact strict gun-control measures, two BU School of Public Health professors assert in the May 28 issue of the New England Journal of Medicine.
"Gun-control advocates need to have a full appreciation of what the Court did and did not do" in the D.C. case, known as District of Columbia v. Heller, wrote Leonard Glantz and George Annas, professors of Health Law, Bioethics & Human Rights. "The Court did strike down one of the strictest gun-control laws in the country. [But] states continue to have very broad authority to regulate gun ownership.
"Perhaps Heller can serve not as an occasion for celebration by the pro-gun lobby, but as an impetus to re-examine current state and local laws to determine whether they are as strict as the Court's interpretation of the Second Amendment would allow."

Sec. 23. RIGHT TO KEEP AND BEAR ARMS. Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime.
Well with the Journal of Medicine issuing its views on the 2nd Amendment, perhaps the NRA should issue its recommendations for heart surgery.
Oh wait, they’re professors of “Health Law, Bioethics & Human Rights”. Maybe the JPFO could tackle that one...
The Tennessee constitution says pretty much the same thing.
The right to keep and bear arms, being in the State Constituion seems more important that in the often ignored United States Constitution......sad.....

Gun control advocates need to have a full appreciation that there are 150 million very pissed off Americans with over 200 million guns. Molon labe’!
