CNN's Toobin: 'Five Conservatives' on Court Ruled for Firefighters

On Monday’s Newsroom program, CNN’s Jeffrey Toobin couldn’t find a consistent argument about the Supreme Court’s ruling in favor of New Haven firefighters who accused their city of reverse discrimination. Toobin first reported that Justice Kennedy, “the swing vote in this case, as in so many others,” wrote the decision, but minutes later, he labeled it as a ruling by “the five conservatives on the Court.”

I’m not sure who Jeff Greenfield is but it seems this Toobin guy has better luck with women than Keith Olbermann.

The incredible bit was Justice Ginsburg's statements on "disparate impact."

How can you design qualitifications so that "impact" is identical for every imaginable grievance group based on their great, great, grandparent's ethnic or national background?

The whole purpose of qualifying exams was to eliminate biased selections and cronyism.

Furthermore, after reading some comments around the intertubes, I have two questions:

1. If you even wanted to, how would you design a firefighter test to make black folks do poorly? How?

2. New Haven is a black-controlled Dem machine. The last thing in the world they want to do there is to discriminate against blacks. It's a ridiculous notion.

Whether you are a liberal or a conservative, it can’t be good that these cases split along ideological lines. What it shows is that justice is meted out by this court based on politics, and that is just plain unAmerican. If the court will not follow the law, but simply issue opinions in accordance with the Justices’ own political beliefs, then why do we need them? We can get any mob on the street to do the same. And for that matter, if the court is going to ignore the law, then why do we need the Congress? Give them their walking papers and save the taxpayer the burden of supporting them.
