EPA fugitive who shot at officers expected to change plea

A Utah fugitive critically injured March 10 during a shoot-out with law enforcement officers in a Marathon trailer park is expected to avoid a trial by pleading guilty today.

Larkin Baggett, 54, formerly of Salt Lake City, was shot in the neck and buttocks after he allegedly pointed an assault rifle at a Monroe County Sheriff's Office deputy and three U.S. Environmental Protection Agency agents.

Baggett was the first man shot by EPA officers in that organization's history.

A change of plea hearing is scheduled today in the courtroom of U.S. Judge Michael Moore at the federal courthouse in Key West.

"Such a hearing usually indicates that a defendant has expressed to the court an intent to plead guilty," said Alicia Valle, spokeswoman for the U.S. Attorney's Office. "However, a defendant can always change his or her mind and proceed to trial."

Valle declined to discuss whether a plea agreement was negotiated with Baggett.

Baggett faces three charges of assault on a federal officer, assault on a person assisting a federal officer and illegal possession of firearms by a felon.

Prosecutors are moving to permanently keep the weapons seized from Baggett's trailer, which included two AR-15 assault rifles, a .308-caliber assault rifle and a pistol that shoots .223 cartridges. It's unclear whether prosecutors also want to seize his property, boat and vehicle.

Baggett was wanted on an EPA warrant for not appearing in court in 2008 on charges of illegally treating and disposing of hazardous waste in Salt Lake City, and illegally discharging acidic chemical waste into the sewer system.

Or, he was an accused felon who jumped bail, went underground on the other side of the country, and was only found when a tipster alerted authorities.

You're right ... they should have nuked him or burned him out ... he was after all sleeping

Hey, I’m just answering the question why EPA agents might want to be armed.

how would they know he was armed and dangerous?

And he was sleeping until one of the super sleuths fell against his trailer in the dark

He had not fled a violent crime and they could have picked him up on the way to the store but then that wouldn't let them have a joint operation with the Feds (EPA) and play with all of the toys

They could have just knocked on the door

Maybe they could have just roughed him up a bit and broken an arm if he was just littering

.

Hey, I’m just answering the question why EPA agents might want to be armed.I agree and I still don't know why they have to be armed

If they have a warrant hand it over to the local police, whooping cranes and snail darters really don't require that much firepower

For dealing with organized crime and large dumping schemes with big crime intricately involved (and armed). Generally that’s been the reason. Not the lone guy.

Green police...time to move your business out of the global warming chicken little’s territory!

This is what is going to happen. Those businesses that can, will move out of dodge and look for safe havens. Those that can not move may not be able to afford business or may not want to take the personal risks involved with exposure to the Left’s gestopo. This will please the water melons.

"Some of the things that they clean H.D. trucks and trailers is very strong. http://www.trailmobile.com/site/files/638/45327/178893/249618/700-99-130_169.pdf This is the MSDS for one cleaner"

That's a pickling solution, not a cleaner for finished trucks. It's used to remove metal and like the label says, it will disolve people. Don't pour it in the sewer. If you do, you should be jailed for a long time. People pay good money for their sewers and they don't appreciate dimwits that disolve them.

"Consider that the next time you pee (Uric Acid)"

Uric acid is a solid and isn't dumped unless you're a bird, or a reptile. It's also a very weak acid, unlike the sulfuric acid your bail jumper dumped in the sewer 50 times that caused the emergency response out in UT.

"If you dumped a 55 gallon drum of Hydrochloric acid down the sewer it would likely react with all the poo and neutralize in 100 feet"

Dumb and ignorant seem to be your specialties.

N-S. I don’t know the concentrations involved here but HF and H2SO4 down the sewer can do serious damage and as some one said up-thread sewers are expensive.

They were there with the local police, which in Florida, if not in a big city, means the Sheriff's officers.

Tard’-N-Re’Tared utilities worker...? I gather you do work with reclamation. You live in the city with evil drug dealing pit breaders next to you? Get your exit plan together, if you don’t already. I lived with it for a decade, leaving was the best thing I could do. There is nothing like lighting up a crackhead at 2 am when you have to get up at 6 and have a former friend with his head in your fridge tell you he is looking for food for his kid when you almost put a load of double ought into him.

If you had storm drains piped in explosive reactions at the concentrations short of massive dumps it was probably not too bad a risk.

I love the 44 open-long as it's legal. I'ld feel better if you just got some place it wasn't necessary, but that's really your own business. Peace.

I’m in Western ny. The laws suck but it is rural, and spaced. Most folks hunt and we know our neighbours. Our cities can go F-themselves. We will have food and water and probably food for my pit bulls and german shepard < smirk >.

EPA officials can carry weapons? They have the power to arrest? Scary, just wait until cap and trade passes and is signed into law.
