EDITORIAL: Sotomayor plays the race card

A biased judge should not be promoted to a higher court. Yet the Obama administration has not been able to put to rest fears that Supreme Court nominee Sonia Sotomayor might let ethnic grievances sway her decisions on the bench.

That's exactly what it appears Judge Sotomayor did in the Ricci v. DeStefano case, in which she ruled that white firefighters could be denied promotions they clearly had earned. That's why it is worth revisiting the Supreme Court nominee's infamous "wise Latina" speech. The renewed focus on that speech should center on two highly objectionable lines that have not received enough attention.

The most quoted sentence from the speech in question, as published in the spring 2002 issue of Berkeley La Raza Law Journal, is that "a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion that a white male who hasn't lived that life." That statement alone is troubling. It suggests that ethnicity trumps the facts and the law. She repeated that line, or variations of it, in at least seven other speeches.

However, that sentence, bad as it is, pales in comparison with two others from that speech -- each of which she repeated on at least two occasions. Article Continues At: The Washington Times

We’ve spent a long time in this country working for equal protection of the laws, but now it appears it’s okay for liberals and leftists to throw out that principle.

OK, so lets look at just that - do those differences make one person more or less qualified?

I supposed she is qualified to judge that - this is starting to suck.

The objection to this Woman sitting on the Supreme Court has NOTHING to do with race, rather that her decisions have been over turned by the Supreme Court more the 50% of the time. If the people who oppose her make this a race issue they will loose.

So, Judge Sotomayor, are you saying that there are differences in the races that make them behave as they do, and are therefore not inherently equal, backing up the claims for centuries of racists? Or are you just making excuses for the very dumb and violent?

Either way that statement excludes you from further court service. Not only do you NOT get on the supreme court, but you are removed from your current assignment. Then you can go on Oprah and whine.

Human garbage.

If you're going to post an excerpt, have the excerpt be the money quote:
In the Berkeley speech, a 2003 speech at Seton Hall University and a 2002 address at Princeton University, Judge Sotomayor said this: "Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague [federal district] Judge [Miriam] Cedarbaum, our gender and national origins may and will make a difference in our judging."

In both the Princeton speech and the Seton Hall speech, she repeated another line, nearly verbatim, from the Berkeley address: "My experiences will affect the facts that I choose to see as a judge."

She is very explicit that she will judge AS a LATINA, and she's not even going to try to be objective.

Make sure you get past the word "inherent" and take a look at one construct she is mentioning. That would be "inherent ..... or cultural differences".

Think about it ~ what is an INHERENT cultural difference? Is that something like "natural rhythm"?

Guess ol'Sotomayor is going to take the Supreme Court back to Judge Taney.

Leftists don’t believe in “equal protection under the law” because a blindfolded justice system doesn’t turn out the decisions that they like.

They believe that all levels of civil authority must be populated by “progressives” with sufficient power to impose their progressive view of justice on our society, unrestrained by laws.

I use the Martin Luther King standard: the content of their character and not the color of their skin. Liberals cringe when a conservative throws one of their own icons back in their faces. But the law should know no color. Neither do facts.

Having said that, there are some professional sports where black men prevail. White men can’t jump. On a much smaller scale, I know whole families that have the music gene, and whole families that have the doctor gene. That doesn’t mean than anyone has more or less (unalienable) rights than anyone else.

If browns (or blacks, etc.) can’t get justice from white judges because of “inherent physiological or cultural differences”, what can whites expect from brown judges? And if women can’t get justice from men judges (because of etc.), what can men expect from women judges?

If two races or sexes are opposed in a legal case, isn’t justice absolutely impossible then, according to this woman?

If this judge is interested in justice, her only logical argument has to be for (*gasp!*) segregation.

(Unless, that is, she’s arguing for repatriation of racial minorities: blacks to Africa, herself to Mexico, etc.)

She shouldn’t even be considered much less nominated but of course LaRaza and all the white hating race based groups shouldn’t exist either.They weld considerable power, influence and money yet way too whites pretend they are innocuous and always mumble something abut not being “racist”. From the NAACP & LaRaza to The Black Caucus & MEChA etc. Are white people ever going to stand up for themselves or are we going to continue this genocidal march toward nation and race destruction? Way too many whites have become deracinated Borg who are at best indifferent and worst accomplices in the mass suicide of the USA. It is time to quit pretending that a large segment of “people of color” and their political, lobbying and social group are not completely detrimental to whites, our communities and families and in fact the the survival of our nation.

a) Jimmy the Greek got fired for suggesting that people of different origins have inherent physiological differences. It may be obvious. But...judges aren't supposed to skew their judgments because of them.

b) "...nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." There's no exception in the Constitution for people with different cultural differences, or with different physiological differences. EQUAL is EQUAL.
