U.S. Army Maj. Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go. His reason? Barack Obama was never eligible to be president because he wasn’t born in the United States. Actually, Obama was born in Hawaii in 1961, two years after it became a state. Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client. In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces. Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.” Cook, a reservist, received the orders mobilizing him to active duty on June 9. According to this document, which accompanies Cook’s July 8 application for a temporary restraining order, he has been ordered to report to MacDill Air Force Base in Tampa, Fla., on Wednesday. From there, the Florida resident would go to Fort Benning before deploying overseas. A hearing to discuss Cook’s requests will take place in federal court here Thursday at 9:30 a.m.

All she has to do is associate herself with a licensed attorney in the state of Georgia in order to appear in this case. It’s called pro hac vice. Then a court has to approve of the arrangement. This is virtually never a problem; especially in federal court. The main reason for this is so that the courts will know that a lawyer who knows the state court rules will be involved.

Obama is tearing our country down - everyone is wringing their hands in despair & doing nothing to stop him.
I think he stepped up to bring attention to the problems we have with this "CIC" and is falling on the sword to get the ball rolling.
The hearing for Major Cook is this coming Thursday morning. We will see what happens, won't we. I am sure Major Cook will be there with proper legal counsel whether it is Dr. Orly or someone else. :)
What recourse does an army Major have to disobey an illegal order on the basis that the person that issued it is ineligible to give said order?

A civilian orders an Army Major to attack a foreign country, not a president, not even a citizen, just someone that decided to order around the Major because he thinks he can.
There a number of reasons why Obama may not be eligible, not the least of which is that he is not a US citizen Naturalised, native born or Natural Born, The congress and the Supreme Court have both failed to uphold their duty to the Constitution, and now a citizen soldier is obeying his oath to defend it.

According to many, it’s not BHO. Anyone ineligible for the job isn’t President, even if sitting in the Oval Office and acting like he is. And that’s the point: if BHO isn’t eligible to be POTUS, then he isn’t POTUS, he isn’t CinC, and he does not have the authority to order the Major around.

I think the UN part makes it a very different situation. He wasn’t really challenging the legitimacy of the president, but the orders.
In my opinion, what reflects poorly on the military and those who took an oath to protect and defend the constitution against all enemies foreign and domestic, is not people like this... The fact that damn near every last member of the military is derelict in their duty to fulfill their oath reflects poorly upon them.

If he wants to throw his military career away to prove a point then fine. I hate der führer more than you but would still serve if called. I was called to active duty during Clinton’s impeachment and still served. The mission always trumps your political views.
I agree. Because He’s a Major, the consiquences are going to be harsher. He can kiss his career goodbye. To refuse orders, you damn well better have your hard factual evidence supporting your actions lined up for review. The Major only has strong opinion and strong suspicions That isn’t going to cut it.

That was my question. If an attorney doesn’t associate, which hasn’t happened yet, what happens to the case?

Each military member swore an oath to the CONSTITUTION not the f-—ing government or the president.
If and when there is any doubt, the constitution trumps EVERYTHING else... Even the CinC, because the CinC could be a corrupt POS that has a blatant disregard for the Constitution and the freedom and liberties it was created to facilitate and protect.
