Pg 354 Sec 1177 - Govt will RESTRICT enrollment of Special needs ppl! WTF. My sis has down syndrome!!

If this is true, and this POS bill passes into law (which it looks more and more like it is going to be one big EPIC FAIL for HolyO!) I hope Sarah Palin sues the crap out of the government for discrimination against people like Trig!!!>:-(

SEC. 1177. EXTENSION OF AUTHORITY OF SPECIAL NEEDS PLANS TO RESTRICT ENROLLMENT.

(a) In General- Section 1859(f)(1) of the Social Security Act (42 U.S.C. 1395w-28(f)(1)) is amended by striking `January 1, 2011’ and inserting `January 1, 2013 (or January 1, 2016, in the case of a plan described in section 1177(b)(1) of the America’s Affordable Health Choices Act of 2009)’.

1395w-28. Definitions

(f) Restriction on enrollment for specialized MA plans for special needs individuals
In the case of a specialized MA plan for special needs individuals (as defined in subsection (b)(6) of this section), notwithstanding any other provision of this part and in accordance with regulations of the Secretary and for periods before January 1, 2011, the plan may restrict the enrollment of individuals under the plan to individuals who are within one or more classes of special needs individuals.


Basically it extends the ability of a state to restrict enrollment by Special Needs individuals in the state’s Medical Assistance plan by another two years minimum.

Can you imagine if George Bush tried to do that?
