When you say that Dershowitz is a political operative, do you think he's seriously angling for a SCOTUS seat? To the best of my knowledge, he's never held an elective or appointed government position on any level.
No, Alan, like Tribe, would be solid picks for the left. Were it not for two problems, they both consider Roe bad law, and both consider the 2nd Amendment an individual right. They'd "regulate" both, as the government regulates all our rights differently than I would. Legitimate disagreements. But they'd never be considered.
BTW, when we have a Republican President, I'd LOVE to see a qualified non government employee considered. Dare I say even a non-lawyer.
