This news is 2 months old but I felt it needed coverage in light of the debate about the death penalty...

A former US soldier convicted of rape and murder in Iraq has been spared the death penalty.
Steven Green, 24, will now be sentenced to life in prison, after jurors in the state of Kentucky could not agree unanimously on his punishment.
A judge is expected to formally sentence Green in September.
In May, the jury found Green guilty of the rape of a 14-year-old Iraqi girl and the killing of her and her family near Baghdad in 2006.
Four other soldiers are serving sentences of between five and 110 years for their roles in the 2006 incident.
Three had admitted holding down Abeer Qassim al-Janabi, raping her and then killing her, her parents and her younger sister at the family's home in Mahmudiya before torching the building.
Mr Green was discharged from the 101st Airborne Division before the case came to light.
He was the first ex-soldier to be charged under a US law that allows prosecution for crimes committed overseas.

Aren’t jurors quizzed on whether they support the death penalty before they judge capital cases? Because if any kind of murder deserves the death penalty, its a rape/murder of a 14 year old child....

Its too easy to be an American citizen. Citizenship by birth is no longer adequate. Potential citizens should be required to express a belief in the Bill of Rights and have no problem with hanging a murdering rapist pedophile mutant.

In another day, wouldn’t a guy like that be dealt with by his fellow servicemen if they witnessed such a horrible act?

I'd say the exact opposite, since jurors are instructed to disregard any potential sentence or penalty resulting from their verdict.
Oh, take the other morons out too. Theu are just as gulity. Even more so, because they could have stopped it

Your use of French (of which I speak none) reminds me of the fantastic Kirk Douglas movie, “Paths to Glory” (1957).
After a disastrous, failed charge during a WWI battle, a soldier from each of three French battalions is chosen to be executed for cowardice. The choices are, at best, random. At worst, a soldier who conflicts with his officer is selected for death.
All to set an example.

I agree. Some sorts of crimes have extenuating circumstances. However a rape/murder of ANYONE deserves death. Swift and sure.
Put him in general population,and that will be that.
And that's been the truth in the military since soldiers wore leather sandals. Hard lesson, but it works. It has to.

A TAR HEEL CONFEDERATE SOLDIER:
May 11, 1863 - We moved our camp to the north side of town. Then we were marched to an open field this afternoon, and drawn up in line to see two men shot for desertion. After they were shot, we marched by them and saw one was hit six times and the other four. Their coffins were by their sides, right close to their graves, so that they could see it all.
