Arrest of Gates also shines a light on 'disorderly conduct' laws (is it well-defined?)

For some defense lawyers, the arrest of Harvard professor Henry Louis Gates Jr. was less about racial profiling than about how persons can be arrested simply for speaking angry words to a police officer.

The laws against "disorderly conduct" give police wide power to arrest people who are said to be disturbing the peace or disrupting the neighborhood.

I was listening to Michael Savage the other day and he seems to think that both Gates and Crowley did the wrong thing.

Savege reasons that both men could have easily avoided a confrontation. Crowley, after learning that Gates was the homeowner and not an intruder, could have left and ignored the abuse.

For his part, Gates continued to loudly berate Crowley as he was leaving the house. He should have quit when the office was leaving.

The writer makes a fair point. But, like Commissioner Ubama, he wasn't at the scene so he doesn't know how disorderly the conduct got.

Whatever "line" there may be, I am inclined to think Gates crossed it.

Hi SeekandFind, I read the police report, and Crowley did leave the premises and went outside. Gates should have stayed inside and the incident would have ended there.

But Gates went outside. That's when he entered the realm of creating public disturbance with his mindless racists ravings and got arrested.

Crowley followed proper procedure and was justified in his actions. So justified that entire police unions are confronting the President and telling him to apoligize.

This guy Savage is an idiot. Gates deliberately provoked the officer because he wanted to create an incident. Gates kept screaming at him while the officer was not responding and was leaving until finally he got the officer to respond by arresting him. Then Gates went out trying to promote this and portray himself as a victim.

I am reminded of a disorderly man, named Al Sharpton, who fanned the racial flames, more than once, and actually got people killed.

Disorderly conduct arrests might, at times, be a threat to liberty.

However, yelling “racist” at a cop is on almost the same level as yelling “fire” in a crowded theater.

It is a volatile, incendiary thing to say.

When you yell “fire” there better darn well be a fire.

Same with racism!

The Smoking Gun has the police report. Read it. I find it hard to believe Crowley would forge or falsify the report to cover his racism. The narrative doesn’t shine too well on Gates. Plus, another officer witnessed the end of the initial confrontation and verifies Crowley’s statements. They would have had to coordinate their reports to make it work out cohesively...

This was Gates’ dream come true... real street cred. Now he can teach his classes about police brutality and institutional racism with battle scars to prove his point.

As I have said before - no way Gates qualifies for the academic stature he now holds. Sadly, he is one of many, many persons in similar positions with similar beliefs.

Seems to me this is playing out exactly as it was planned.

zer0 knew what the results of his statements would be.

Not only does he have a distraction from his nazi health plan, he's stirred the racial tension plot and for all we know created the "spark"

The report also states that Crowley warned him twice after going outside to settle down. Gates had every chance.

Someone had a thread here running about an interview Brian Lamb did with gates regarding one of gate's books and it was revealing...in it gates said his mother 'HATED' white folks and was thrilled when malcom X came on the scene and got right up in white folks faces, she LOVED Malcom for that.

gates said he worried about bringing a white woman home he wanted to marry, cause of his momma. Who raised a big stink over it. But gates did marry a white woman. Maybe that is a psychological way to get even.

If Mass. didn’t imprison the “Swimmer” for murder, and Studds for “rape” why would they ever consider prosecuting an arrogant black AHole for disordly conduct! It was a good arrest.

Heck, I now wish that Crowley had considered Gates a threat to himself and/or others , and taken him in for a mental hold. Gates is a dangerous racial nutcase.

You can even SEE a still picture of a policeman on the porch, (actually there is a policeman behind gates, one beside him and a black policeman down the steps of the porch) with his hand raised in a calming gesture, palm down, towards gates.

Gates was obviously raising a stink...playing the poor me card when SOMEONE HAD COME TO PROTECT HIS HOME to the nth degree.

I just wish one of the officers had taken gates, pulled his pants down, laid him over his lap and given that spoiled, tantrum prone racist gates a good old fashioned PUBLIC SPANKING. Smacking that old black arse with some solid umps. Somewhere along the line, gates missed out on discipline.

And this incident still offends non-racist Americans. We all know the incident never rose to a level that it required any comment by a president that admitted not knowing the facts. But Zero shoots off his mouth anyway.

Now from all appearances, and based on the police report, there is little doubt the incident was provoked by Gates. Zero owes Crowley, and the police service, an apology. Now Zero compounds the original stupidity by inviting BOTH Gates and Crowley to the Whitehouse for a beer, but still no apology where due. If I were Crowley, I would have refused the invitation and suggested that Zero simply drink two beers.

I’m trying to imagine myself in the same situation. I’m guessing I’d be telling the officer how grateful I am to him for checking up on my house in the face of a burglary call. But that’s just me.

Savage is a fool.

If this had happened down the street at Harvard Square, Gates (or anyone for that matter) would have also been arrested for Disorderly there. Doesn’t make any difference that he hurled insults from his front porch in front of AT LEAST 10 people.

If in the urban locale of Ware Street with many apartments, someone had called the police on me for possibly breaking into my own home, I wold have been peeved at the caller, not the cops.

Gates is a racist and has several identifiable mental and anger problems.
