Not quite. Depends on the terms in the lease. Any number of businesses (gun shops, for example) will ask for -- any many times get -- terms written into the lease that they are exempt from complaints about the sale of products that are fully lawful to sell in the location in question.

With the huge slump in commercial real estate, I should be VERY surprised if such terms are becoming more and more common. Especially so after this little incident.

The article cited a reference to “free speech”. This is not a “free speech” issue.

He may, as you state, have a lease violation civil complaint if they have violated the lease in some way.
