Under Obamacare, it will be ZERO percent. All doctors will be socialized and immune from lawsuits. According to the House bill, doctors will act as independent contractors, rather than as government employees, and will expressly be subject to liability actions.
The government panel making decisions about one's health care, that the doctor is supposed to execute, is immune from legal action.
