Shocker! Judge orders trial on eligibility issue

A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.

In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.

But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

Judge Carter graduated from college and enlisted in the Marines during the Vietnam War. He was an officer and received a Purple Heart and Bronze Star at Khe Sanh.

A horse head in the bed or a chicago thug threats are pretty minor compared to being a Marine at Khe Sanh.

C-130’s had to do hot drops because the base was essentially surrounded by the NVA and Viet Cong. There were daily air strikes to keep the base from being overrun.

If not a NBC he could be a citizen of Kenya or a Native born citizen of the US.

...Now, if he is not a citizen at all, how can he be charged with treason against a country he is not a citizen of?.....

Right...you got me there. I should have used "terrorist", "saboteur", or ..........Wait a minute...

The Constitution of the United States, Art. III, defines treason against the United States to consist only in levying war against them, or in adhering to their enemies, giving them aid or comfort. This offence is punished with death. By the same article of the Constitution, no person shall be convicted of treason, unless on the testimony of two witnesses to the same overt act, or on confession in open court.

Nothing about being a citizen in this! I may be saved...{:-)

On further review (of your excellent question): Leave in "treason" and additionally include "terrorist" and "saboteur".

I stand corrected. However, this judge excepted, I stand by my general premise; you have to admit it’s pretty close to the norm these days.

If the motion to dismiss is denied, there will be discovery and I don’t think this judge will tolerate any silly games by Obama’s attorneys to delay discovery.
