Here is the Justice department's reasoning why it should be dismissed

"It is clear, from the text of the Constitution, and the relevant statutory law implementing the Constitution's textual commitments, that challenges to the qualifications of a candidate for president can, in the first instance, be presented to the voting public before the election, and, once the election is over, can be raised as objections as the electoral votes are counted in the Congress," wrote Assistant U.S. Attorneys Roger West and David DeJute. "Therefore, challenges such as those purportedly raised in this case are committed, under the Constitution, to the electors, and to the Legislative branch."

Except that the full qualifications WERE NOT submitted to the public for scrutiny. Their whole argument is that since he managed to hide his documents from the people before the election, and the electors and Congress didn't challenge it, then tough shit.

It all goes back to the Jan 15?th day, at ?1:15pm where the Speaker of the House (pelousy) was supposed to ask if there were any evidence why not 0 should get the presidency?

And she moved so fast to ceremony that nobody was able to file an objection?

I think alot of people are missing the boat on the signifigance of this news today.

Obama for the first time is openly using tax payer dollars to argue that no Amercan citizen has standing and that no Court has jurisdiction to challenge his eligibility.

This is really big news. I think it will now start to draw more media attention because of this.

No Obama supporter can argue anymore that Obama is not fighting this case. He is now for the first time using taxpayer dollars and has hs official stance in print.

The Obama official stance is that no Court or no citizen has a right to challange his elgibility. He no longer can hide behind private lawyers. This is now an official administration stance.

"challenges to the qualifications of a candidate for president can, .......be raised as objections as the electoral votes are counted in the Congress"

If you watch the end of the Congress count, at the time when Cheney is supposed to ask if there are any objections, Pelosi jumps in first and leads the cheer confirming Obozos election. She shut out any objection. Some say a hand was raised to object.

How does the DOJ argument apply to a lawsuit brought by someone such as Colonel Hollister, which seeks to know if the One can give legitimate orders to call up the Individual Ready Reserve as opposed to the order coming from Biden if the One cannot give a legitiate order? How does having gotten away with fraud legitimate an order?
