U.S. Begins Immigration Crackdown on Federal Contractors

For federal contractors, it is time to start checking whether employees are able to work legally in the United States.

Beginning Tuesday, the U.S. government was requiring federal contractors to use the E-Verify system to check the immigration and citizenship status of the people they hire and assign to new federal contracts.

"Don't panic about this. You do have time, but the time will pass quickly, so vigilance is important," Bonnie Gibson, a partner with New York-based Fragomen, Del Rey, Bernsen & Loewy law firm, told hundreds of contractors who dialed in to a conference call last week for an explanation of the Obama administration's latest immigration enforcement rule.

Contractors have 30 days from the date a contract is awarded to enroll in E-Verify, and 90 days to start submitting information on new hires and certain current workers. Contractors have the option of checking their entire work force, once they notify the government of their intent to do so. They also will be responsible for requiring subcontractors to use E-Verify.

One important note. The AP wrote this and includes a BS statement.

It is not the "Obama administration's latest immigration enforcement rule". It is Bush's executive order:

Did the Bush administration really wait 7 years and 5 months to issue an Executive Order to keep illegals from working for contractors?

E-verify works like any other government program. It makes no sense. You cannot run the social security or resident card unless you have already hired them. And if you run it and find you’ve hired an illegal, you are forbidden to fire them. So now the government knows you’ve hired an illegal.

I agree. The way around this is have them go through MEPS. Seriously. Noncitizens will not make it through (and NO they don’t have to go into the military). Either that or just hire veterans.

Actually, I think if you look at ICE’s E-Verify or SAVE program page, using the programs provides you protection on immigration enforcement actions. I’m not sure anyone would forbid you from firing them (other than trial lawyers and, maybe, sanctuary cities), I think ICE explicitly states that they must be terminated or the record rectified within X number of days.
