COW PALACE GUN SHOW BAN (Leno) |
Description: |
SB 585, as amended, Leno. Agricultural District 1-A: firearm sales at the Cow Palace. Existing law generally regulates the transfer of firearms and divides the state into agricultural districts. District 1-A is the County of San Mateo and the City and County of San Francisco. A violation of statutes governing agricultural districts is a misdemeanor. This bill would prohibit events at which firearms and ammunition are sold at the Cow Palace, as specified, located in District 1-A, except as provided, and would thereby make a violation of that prohibition a misdemeanor. The bill would authorize up to 5 of those events per year until they are replaced for 3 years and would require the district to replace those events with nonfirearm and nonammunition events, as provided. By creating a new crime, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes. |

09/09/2009 - Today, SB 585 Cow Palace Gun Show Ban failed its first vote on Assembly floor. It failed 39 'Yes' - 25 'No' (41 'Yes' votes needed to pass). The bill is on call and could be voted on again at any time. Please continue to contact the members of the Assembly and urge a NO vote on SB 585. The Legislative Session ends on Friday, 9/11/2009. UPDATED INFORMATION: SB 585 passed on the Assembly floor with the minimum 41 votes. It now goes back to the Senate for approval. Contact the members of the Senate and urge them to vote NO on SB 585!

Description: |
AB 962, as amended, De Leon. Ammunition.
Existing law requires the Department of Justice to maintain records pertaining to firearms transactions.
This bill would require the department to maintain additional information relating to licensed handgun ammunition vendors, as specified.
Existing law generally regulates the sale of ammunition.
This bill would establish a program administered by the Department of Justice for licensing handgun ammunition vendors, as specified.
The bill would establish a database maintained by the department to serve as a registry of handgun ammunition vendors.
This bill would require that commencing July 1, 2010, unless specifically excluded, no person shall sell or transfer more than 50 rounds of handgun ammunition in any month unless he or she is registered as a handgun ammunition vendor, as defined. The bill would also require employees of those vendors who would handle, sell, or deliver ammunition in the course and scope of their employment to obtain a certificate of eligibility, as specified.The bill would require the Department of Justice to maintain a registry of registered handgun ammunition vendors, as specified. The bill would provide that no vendor would be authorized to sell ammunition pursuant to a handgun ammunition vendor license unless the vendor is listed on the centralized registry.
The bill would also provide that no retail seller of
ammunition handgun ammunition vendor, as defined, shall sell, offer for sale, or display for sale, any handgun ammunition in a manner that allows that ammunition to be accessible to a purchaser without the assistance of the retailer vendor or employee thereof. Existing law generally regulates what information is required to be obtained in connection with the transfer of ammunition. This bill would, subject to exceptions, commencing July 1, 2010 February 1, 2011 , require certain ammunition vendors handgun ammunition ven dors to obtain a thumb print and other information from ammunition purchasers, as specified. A violation of these provisions would be a misdemeanor. This bill would provide that a person enjoined from engaging in activity associated with a criminal street gang, as specified, would be prohibited from having under his or her possession, custody, or control, any ammunition. Violation of these provisions would be a misdemeanor. The bill would prohibit supplying or delivering, as specified, handgun ammunition to prohibited persons, as described, by persons or others who know, or by using reasonable care should know, that the recipient is a person prohibited from possessing ammunition or a minor prohibited from possessing ammunition, as specified. Violation of these provisions is a misdemeanor with specified penalties. The bill would provide, subject to exceptions, that commencing July 1, 2010 February 1, 2011 , the delivery or transfer of ownership of handgun ammunition may only occur in a face-to-face transaction, with the deliverer or transferor being provided bona fide evidence of identity of the purchaser or other transferee. A violation of these provisions would be a misdemeanor. By creating new crimes, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. Vote: majority. 09/08/2009 Update - AB962 Handgun Ammo Sales Registration - Sales Ban
The bill was drastically amended on Friday, 9/4/2009. Some of the provisions deleted: - The new license for handgun Ammo Dealers
- Ban on the transfer of more than 50 rounds of handgun ammo between private persons
- Use of the DROS Fee (background Check Fees) monies for implementation of the Program

NRA and CRPA remain opposed to the bill. It still requires: - Registration and finger printing of handgun Ammo Purchasers
- Mandatory storage / Display requirements for Ammo Dealers
- Ban on the Sale of Handgun Ammo through the Internet or mail Order
Stay tuned for more information. The bill can come up for a vote on Wednesday, 9/9/2009. If it passes the Senate it must go back to the Assembly for a final Vote. The Legislative Session ends on Friday, 9/11/2009. |

I said that on another thread that if this passes, they should just continue to have gun shows at this location. Still bring guns and display them on tables. But you can’t sell guns! That’s OK, for $790 you can sell an OPTION on an $800 pistol, so that the option buyer can purchase it for $10 any time within the following week. See, private enterprise to the rescue.

The goal is to stop all firearms and ammo sales at the site.
