The Case for ACORN as a Criminal Enterprise

It now looks very much like there was a lot more truth to the criticisms about ACORN—the Association of Community Organizers for Reform Now—than its leadership, its allies on Capitol Hill and its supporters in the media were willing to acknowledge....

This latest round of problems for ACORN may be the best documented, but they are not the first nor, for that matter, are they the most serious. A report issued last summer by the Republicans on the House Oversight and Government Reform Committee, according to Sunday's Washington Times, "presented evidence that ACORN had engaged in criminal misconduct."

Among the findings, the report said, ACORN:

* Engaged in tax evasion, obstruction of justice and aiding and abetting a cover-up of nearly $1 million embezzled by Dale Rathke, brother of group founder Wade Rathke;

* Committed investment fraud, depriving the public of the right to "honest services," and engaging in a racketeering enterprise affecting interstate commerce;

* Conspired to defraud the United States by using taxpayer dollars for partisan political activities;

* Submitted false filings to the Internal Revenue Service, and the U.S. Department of Labor; and, Violated the U.S. Fair Labor Standards Act.

Any one of these is a serious allegation. Taken together, they give ACORN most every appearance of being some sort of massive criminal enterprise worthy of a federal investigation of the sort made under the terms of the Racketeer Influenced Corrupt Organizations Act—or RICO. In fact the group and its affiliates are currently the target of more than a dozen lawsuits related to voter fraud in the 2008 election alone.

Wow, coming from US News, the cracks begin to appear.

Thank allah Obama had nothing to do with Acorn or he’d be in deep doo doo.

Can an individual state’s Attorney General investigate ACORN? We know DOJ will “investigate” to shut it al down - but does a state, like Nevada for example, have any jurisdiction to not only investigate, but also indict and expose them?

I was wondering the same thing. Rep Issa in CA is investigating and doing good work. Does the DOJ override all else? Hope not. There should have been IRS investigations by now—but it appears they are partisan hacks now(and a good idea for a FAIR TAX system). Nothing seems to have been done, although attention has been given to their corrupt activities. We still don’t know ALL the many offshoots they have spawned and what they do and how they get funding. Of course, ZERO is unaware of the funding.

If you employ people who aid and assist lawbreakers, who encourage criminality, openly misrepresent established regulations and intentionally traduce America/Americans ... Yes, you are a criminal organization.

This was all done on OUR nickel. ..and, I will bet the lowest person on the totem pole at ACORN makes tons more than I do…and doesn’t work as hard for it.

ACORN was founded with the intent to commit vote fraud. That’s the organizations purpose.

Several are already doing it. I assume that as long as ACORN has a presence in a state, the AG can investigate.

But I am not a lawyer, so this is amateur opinion.
