Gay blood donor sues over sexual-history questions: Claims charter rights violated

A gay man who repeatedly gave blood after lying about having sex with other men is suing Canadian Blood Services, alleging the questionnaire used by the agency to screen out unsuitable donors is a violation of his charter rights. Kyle Freeman alleges the blood collection agency violates his charter rights and those of other gay men by asking male donors on the questionnaire whether they had ever had sex with a man, even once, since 1977.

His ‘charter rights’ end where the rights of others to not be harmed by his actions begin. If his giving blood could potentially harm someone else, you’re darn tootin he should be asked the question. If he lies, he should be prosecuted! Giving blood is not a mandated activity; it’s completely voluntary, so if he doesn’t like the questions being asked, he shouldn’t give blood!

Reminds me of the guy who was legally blind and sued UPS for not giving him a job as a driver.
Judge threw it out of court.

I would like to see judges have the power to fine the lawyer for the ‘plaintiff’ for even wasting the court’s time.
Have the fool lawyer write out a LARGE check to the judge’s favorite charity or something.

In this case- write the check to the blood bank.

The transmissivity of HIV through normal heterosexual (unprotected) sex is miniscule compared to homo sex. The homo lobby campaigned throughout the 90s, with a lot of success, to get people to believe that any type of sex equaled risk of acquiring HIV.

The biggest problem with “gays” in the US is the fact they are the #1 vector for the spread of infectious diseases among humans and many foreign nations want rid of this public health threat. Male homosexuals have the highest incidence of HIV/AIDS, syphilis, drug-resistant gonorrhea, entamoeba histolytica, chlamydia, herpes simplex II, Chancroid, Drug Resistant TB, Hepatitis A, Hepatitis B, Hepatitis non A & B, just to name a few. The press of course never discusses the CDC facts, but if you want to look for yourself the information is in the scientific literature. More than any other segment of society, the homosexuals are costing us billions in medical care.

Mr. Freeman admitted he knew he wouldn't be allowed to donate blood had he admitted to having sex with other men

Is he more concerned about his "right to donate blood" than about his ability to give AIDS to someone else? Does he think it would be great if everyone gave blood with no screening at all? Would it be OK with him if he gave blood that turned out the be infested with AIDS and it was given to someone?

What a turd.

There's something else that wasn't mentioned in the article. If an “ineligible” donor lies on the form — because he doesn't want to be excluded in front of family or friends — he can simply affix a “Unit Exclusion Label” to his form. Every donor is given two bar-coded labels — one for “use”, the other for “don't use”.

All that anyone, who felt it necessary to lie on the form, has to do is affix the “don't use” label & the blood supply is protected. His privacy is protected — no body at the clinic knows there may be a problem with his blood.

The perp has no excuse — this was a deliberate act, carried out with no regard for the safety of others, as a “political statement”

If only that could be done!

There is a real risk that the public will completely lose confidence in the blood supply system.

The government (as monopoly health-care provider) strongly discourages any individual blood banking. If you know you're going to have an operation soon, you can bank some of your own blood — and many people do. But, AFAIK, you aren't allowed to bank your blood for indeterminate times.

If the public loses confidence in the blood supply — people will demand the right to store their own blood. This would be hugely expensive & would create serious shortages of supply for the pooled blood bank. (All the supply is donated here — sales are prohibited.

How do the U.S. blood banks work, by comparison? Is there much banking of own-blood by individuals?

Not to minimize the AIDS aspect of it, but since gays claim that gayness is genetic... so people should know if they’re getting gay “genes” when they use donors. People seek donors with high IQ’s and other traits, so disclosure about gay/straight should be a choice too.

A girl who was a grade below me in high school had a rare blood disorder that required a transfusion. She received some of that tainted blood and was diagnosed HIV+ in 1982. She lasted 25 more years, but her life was a living hell.

Cain’t remember the kids name. He made the cover of Time because he contracted aids through a blood transfusion. I believe he was a hemopheliac. Because he became a public figure Elton John mounted his PR steed and came to the resuce. I believe the kid died at 17.

They want to remove the Homosexuality = AIDS stigma, even though there’s strong enough correlation to warrant such questioning and subsequent restrictions.

Do you mean, like, the fact that gays make up 1-2% of the population, but gay men account for about 70+% of the AIDs cases?
