I did not know the case was seeking removal from office. I thought the object was to obtain proof of eligibility WRT the BC. The American people have a legitimate interest in knowing whether their President is holding office legitimately.

What if they don’t do their job which seems to be case.

I think we, the people, having standing. Just look at what Obama has wrought on our country in only 7 months.

I also thought the harm was not an issue because some of the plaintiffs were on the ballot. As far as standing - if Congress failed to do their job and he is a fraud than the public should have standing.

There was a questioned the Judge asked more than once that was pretty postive. He said something like Congress and Obama may be the same people or have the same interests so why would they check.

It never ceases to amaze me that we have a right to an honest election, but when allegations of fraud are raised we don’t have standing or someone has to prove harm. Is not the violation of that right harm enough and do we not all have standing as voters?

However, the pertinent issue is the dismissal motion filed by U.S. attorneys defending Obama are whether the court - and not Congress - is the proper venue for challenging the president’s legitimacy...

Since we have three co-equal branches, wouldn't either of the other two have a say if they so chose?

Didn’t Carter make the arguement that Congress could essentially be the same person as Obama or at least the same political party so that Congress had the incentive to NOT check.

Judge Carter's words:

"Regardless, the vast majority of the people I know who have run for government office are honest and ethical.”

I think we can see where this is going.

“What if (McCain’s) mother had been in transit to West Germany and he had been born prematurely” in flight? Carter proposed. “How can you take the child of an American mother and say he can’t run for president.”

So there's no difference btw citizenship and natural born citizenship in this judge's mind.

No one has questioned reports that Obama’s Kansas-born mother was an American citizen.

Or whether she's even his mother.

Carter also took exception to two Kenyan documents filed by Taitz that she alleges may prove that Obama was born in Kenya. Both documents have drawn skepticism from experts.

What experts?

“Why am I going outside of my country for documents?” Carter asked. “I always thought our records and our country was to be emulated. These birth documents from Kenya are controversial.”

We're going outside the country for documents because there are no comparable documents, ie. long form BC, to be found in country.

How dense.

The exact same argument was made in many of the federal cases that were filed challenging the constitutional authority of the Vietnam war. Many tried to argue that either the Gulf of Tonkin resolution was inadequate for ongoing military operations, or that no authority was granted at all - meaning Congress has abdicated its responsibilities. All were rejected.

A difference is that while certiorari was frequently rejected back then, there were several liberal Justices that dissented in the court's refusal to grant cert in some of these cases - which is rather unusual.

It's telling that in these cases presidential eligibility cases, none of the conservative justices have done anything similar (commented on the refusal to grant cert) - which should indicate both their respective appetites to hear such cases as well as the strength of the cases themselves.

Carter also broached the idea that being born in the U.S. might not necessarily be requirement to be president. The definition of “natural-born citizen” has been the source of debate. Presidential candidate John McCain was determined to be qualified because he was apparently born on a U.S. military installation in Panama.

Why when it comes to these stories about "natural born citizen" they can never get it right? McCain was not born in a US military installation.

All of these articles should also contain the following information:

To this day Barack Hussein Obama Jr. aka Barry Soetoro arrogantly REFUSES to release his Certificate of Live Birth because of his belief that he is above the law!

You have to wonder why she abandoned him. I see little resemblance btw Stanley Ann and Barack. He really doesn’t look of mixed race to me. Claiming that he is was probably only a scheme. Only revealing the BC would prove that he has any white in him at all.

So wait a sec... the FEDERAL lawyers argued that only the Electoral College and Congress can remove a sitting president... who said anything about removing the President... umm, that’s not the issue here, the issue is that we want to see the birth certificate.

Did the Feds jump the gun in their arguments and essentially argue it right to Orly?

Thanks for posting. This is not encouraging.

The vast majority of people who have run for office did not work,train, raise money for and were closely aligned with ACORN.

He is clueless about NBC.

Meanwhile - Marines die in Afghanistan because the usurper says they cannot fire back. Have you heard that one Judge Carter?
