They should have gone to trial.
Adversarial Possession is well established in law.
However, there are some key issues:
1. Maintenance of the land.
2. The payment of taxes levied on the land.
3. A notice of adversarial possession to theowner.
Without knowing all of the facts, it is hard to judge, but the issues of paid taxes and maintenance of the land seems clear.

By maintain it - I mean pay attention to it and visit it regularly. If you note squatters, maintain your rights to the land by forcing an eviction.

First year of law school - first week of real property law - adverse possession. It goes back centuries. If you own it - maintain it. Also well covered in Business Law for business majors.

My attorney successfully convinces their attorney that we can show adverse possession, regardless of any survey...I just wouldn't have done that. Now getting another, corrected survey done, that's another thing...
