Sheriff Joe held a sweep in NW Phoenix, Friday October 16, 2009. He had a press conference after. US Department of Justice Officials (approximately 5) showed up at the conference, UNDERCOVER, POSING AS REPORTERS. When contacted by a Sheriff commander, the Federal Civil Rights officials posing as journalists, conducted themselves "unprofessionally" and "refused to provide official identification. Only one official from the "covert team provided any form of ID when pressed." That was the senior trial attorney, (phonetics) G. Yong Jung. She has been conducting the DOJ's investigation of the Sheriff's office re: allegations of racial profiling. Ms. Yong Jung (Phonetic) confirmed that those who REFUSED TO PROVIDE ID TO THE SHERIFF DEPARTMENT WERE Department of Justice Officials. 'The DOJ attorney is a max contributor to Obama campaign and seeks a judgeship.'

DOJ Engages in Misconduct - Cover Up in Sheriff Joe Case
The Muffled Oar has previously reported on the dispute between Maricopa County Sheriff Joe Arapio and the Department of Justice. Why is the Department after him? Because Arpaio doesn’t have enough Spanish spoken in the jails and does an extremely good job finding and ensuring illegal aliens are deported.

It has been reported that an attorney involved in the matter may have engaged in illegal and unethical communications without the lawyers present on the other side. Even worse, the Department may have obtained documents illegally.

The Department of Homeland Security had a separate and distinct investigation of the Sheriff. The Department of Justice lawyers are alleged to have illegally called the shots in the DHS investigation and obtained through DHS requests documents which DOJ had no right to obtain. That much has already been reported here and in other news outlets. But what hasn’t been reported are the details of DOJ’s efforts to cover up this wrongdoing and buy the silence of Maricopa County before the details of the wrongdoing became publicly known. The Muffled Oar’s sources report the truth is far worse than what media outlets like the Arizona Republic has thus far reported.

In the wake of the controversy, Chief of the Special Litigation Section (SPL) Shanetta Cutlar reached out to Clarisse McCormick in the the Maricopa County Attorney’s Office and offered to strictly segregate the DOJ and DHS investigations. More specifically, given the controversy (and the unethical conduct by Trial Attorney Je Yon Jung) over SPL using documents and information gathered by DHS auditors — which would circumvent attorney-client privilege — Cutlar told the County attorney that, if it would cooperate with the Justice Investigation, SPL would not use any of the documents gathered by DHS. (Cooperate means consent to interviews and document hand overs.)

Whether or not SPL would really have been able to abide by Cutlar’s promise is something we’ll never know. Why? Because before Maricopa County’s McCormick could respond to this offer, Ms. Cutlar advised Deputy Assistant Attorney General Steve Rosenbaum (yes, him again) of her offer. Rosenbaum responded with anger and said that Cutlar had no authority to make such an offer and ordered her to rescind it. Cutler objected. So Ms. Cutlar was forced to contact Ms. McCormick and rescind the offer.

Stated another way, Rosenbaum mandated that SPL use documents gathered illegally in violation of the attorney-client privilege. SPL Section Chief Cutler strongly opposed Rosenbaum’s command and the unethical consequences. She articulated these objections to Rosenbaum. Even worse for the Department of Justice, as has been reported, the Sheriff has now refused to cooperate with the Justice investigation. And in no small part, the Civil Rights Division has the petty Steve H. Rosenbaum to blame.

Muffled Oar readers will recognize the name Steve Rosenbaum. He is the same poltical hatchet man that:
1. Endorsed race discrimination against white New Haven Firefighters.
2. Enabled armed black panthers to get away with voter intimidation.
3. Went after the North Carolina Republicans for voter intimidation for sending junk mail.

Will any Arizona newspaper have the skill and guts to report on the fight inside Justice on how to handle the unethical behavior of Je Yon Jung? Will the Arizona Republic have the courage to report that illegal conduct by Department attorneys is being used to build a case against the Sheriff? Cutler wanted to fix the problem but Rosenbaum overruled her and made it worse. Will the dinosaur media cover it? Don’t hold your breath.

The Good Sheriff is in real danger. The only thing that might save him is more and even more publicity. We got to watch his back.

Not sure how things work elsewhere, but here in Texas if a law enforcement officer asks someone to provide their I.D. and they refuse or provide something invalid, the person is arrested and hauled to jail.

Sheriff Joe’s debupties should have arrested all of the masquerading DOJ folks for refusing to provide proper I.D.

NAPAWF believes that true comprehensive immigration reform must be grounded in principles of human rights and include provisions that support all immigrants, their families, and communities. Just and humane immigration policies must prevent the trafficking and exploitation of immigrants and end harsh immigration enforcement practices. In partnership with immigrant rights, women’s rights, and reproductive justice organizations, NAPAWF will advocate for comprehensive immigration reform legislation that incorporates the following set of principles:
Provide a Path to Permanent Residency and Citizenship
Immigrant Asian women contribute to the U.S. economy, keep their families together, pay taxes, invest in their children’s education, and are an integral part of their communities.
