If he had used the term "nigger" I suspect it would be in his record and he would have been demoted. Or forced out if it had happened more than a few times. But apparently the officers were ambiguous about his wanting to "cut throats"... etc.
So, no I don't know what side they'll be on. A few years ago I would have bet their loyalty would be to the men and women who were gunned down. Now - I don't know. What's your best guess?

Don't fear. There's a very reasonable - even likely - chance that Obama will be long out of office by the time this gets to the Presidents desk.
The only thing to worry about is the last time a military execution request came before a Democrat President - JFK in '61 - it was denied. Not a good track record there.

On the other hand, these killings did take place on Texas soil. Maybe the state should prosecute?
While not technically impossible, I have a better chance of being crowned King of England. It's a military shooter, with military victims on a federal reservation. The Feds could assert jurisdiction if they find evidence of a broader conspiracy, but for Texas to get a crack, both the military and the feds would have to pass. That's not going to happen.
Occasionally, you will see state authorities prosecute crimes committed on federal reservations. Most frequently, these crimes are domestic in nature ie, a civilian spouse hits her military husband over the head with the frying pan. Since she's not in the in the military, and there's no federal statute against braining someone with the Calphalon, the the feds let the staties prosecute. That's not going to happen here.
