Carrie Prejean on Tuesday defended a recently surfaced erotic video of her as a youthful indiscretion and questioned whether it could actually be called a “sex tape” since no one else appears in it.
Prejean admitted to making the video of herself and sending it to her boyfriend when she was 17 years old.

TMZ had the sex tape months ago and never reported it. The sex tape is relevant to Prejean’s suit, because she indicated to the pageant that there were no photo or porn tapes made of her. She lied.
Prejean needs to disappear, quick. She’s done more violence than good.
In that case, based on some recent prosecutions, Prejean could be charged with producing and distribution child pornography.
All this kid did was answer a question, and now she’s a hero.
Unbelievable. That’s a pretty low mark to hit to attain heroism.
I don’t know what she did with regard to this issue, but whatever it was, it was bad judgement, even for a kid of that age.
Easy to prove if done on a cell phone .
She actually surrendered on her lawsuit withing 15 seconds of seeing the tape.
Age of consent is irrelevant in regardes to child porn.

All that “appears” is that she had a scumbag ex-boyfriend who was willing to sell her out for money.

It appears that a tape existed. If the tape didn’t exist, then nothing to sell.
You are right. Statutory rape laws. Even if she was seventeen and he was the same age, she is technically a minor at the time and therefore, if they are viewing it, they are watching a minor have sex, which is technically child pronography and illegal.
Carrie and all Christian Girls/Women need the think about this passage in the Holy Bible before getting involved in the Pagent “Industry”:

If you believe TMZ, they might have had the tape but their reasons for not releasing it were not altruistic. Their lawyers told them prison awaited TMZ’s owners for broadcasting or even admitting they owned a child porn tape.
And yes, Ms Prejean needs to disappear. Quickly.
Yep. She sure could. She was a minor at the time.
The boyfriend who sold it can be charged. Was he a minor at the time it was sold?
The person who bought it can be charged, were they a minor at the time it was bought?
Anyone who viewed it can be charged. Were they minors when they viewed it?
Now, if prosecutions were to begin, would you rather be Carrie Prejean or anyone else in the line of fire?

I would have to plead the fifth after looking at that picture, or nolo. But then again, they cannot put you in jail for your thoughts right...er...guilty I guess.
